First, I think that anyone that attempts to justify Jihadist activity, is violating the various prohibitions on "incitement to violence."

Mike Mallory and similar media personalities, have this special First Amendment protection which they often use and abuse. But really, in the US, no one wants to get entangled in a First Amendment battle in the courts. That doesn't mean that what media personalities like Mallory do is right or proper. It only means that they are able to do in the US what they would not be able to do in the Middle East.
