Ok. Now stand before the jury and say it was premeditated when the offender was drunk. That isn’t in the Gateway Pundit story. But it is in others. Now you have diminished capacity entered into the mix. Premeditation is doubtful with a jury. So first degree is out.

With the guy seeing political enemies everywhere and chasing him? Ok. Now you get to bring sanity into question. A few shrinks come out to testify that the guy suffers from paranoid delusions and now any murder charge is questionable.
