Why would they block ANYONE from being on a ballot if they qualify? Is that how democracy works? People can only vote for those a judge agrees is worthy?
They won't keep him off the ballot if QUALIFIED. The point, is to keep him off the ballot if the candidate is UNQUALIFIED. These 6 republicans filing suit are qualified candidates who believe it is unfair to qualified primary candidates to run against a candidate who is legally, unqualified.

What's being argued now, are measures by Trump's legal team to stop the trial, before the trial....to throw out the trial.

States that might block Trump from the ballot pursuant to Section 3 of the 14th Amendment are states Trump likely wouldn’t win in in the General Election, such as Colorado.

Indeed, it could benefit Trump in that it would enrage and motivate reprehensible Trump supporters.
They'll be enraged - aren't they always enraged? But motivate them to do what?

There are other considerations. Blocking Trump from the ballot makes a lot of Trumpers stay home, hurting the down-ballot Republicans.
 
It's going to be real hard to win 270 electoral votes when you can't even compete in certain states. Not that he would win 270 in the first place. MAGA is done.

A judge has rejected three more attempts by former President Donald Trump and the Colorado GOP to shut down a lawsuit seeking to block him from the 2024 presidential ballot in the state based on the 14th Amendment’s “insurrectionist ban.”

The flurry of rulings late Friday from Colorado District Judge Sarah Wallace are a blow to Trump, who faces candidacy challenges in multiple states stemming from his role in the January 6, 2021, insurrection. He still has a pending motion to throw out the Colorado lawsuit, but the case now appears on track for an unprecedented trail this month.

A post-Civil War provision of the 14th Amendment says US officials who take an oath to uphold the Constitution are disqualified from future office if they “engaged in insurrection” or have “given aid or comfort” to insurrectionists. But the Constitution does not spell out how to enforce the ban, and it has been applied only twice since the 1800s.


A liberal watchdog group called Citizens for Responsibility and Ethics in Washington filed the Colorado case on behalf of six Republican and unaffiliated voters. The judge is scheduled to preside over a trial beginning October 30 to decide a series of novel legal questions about how the 14th Amendment could apply to Trump.

In a 24-page ruling, Wallace rejected many of Trump’s arguments that the case was procedurally flawed and should be shut down. She said the key question of whether Colorado Secretary of State Jena Griswold has the power to block Trump from the ballot based on the 14th Amendment “is a pivotal issue and one best reserved for trial.”

Wallace also swatted away arguments from the Colorado GOP that state law gives the party, not election officials, ultimate say on which candidates appear on the ballot.
The Lawsuit to block Trump has interesting funding, imho. I watched Brian Kilmeade on FNC a while ago. He says that Iran has a finger in every pie to stop Trump from running in 2024. His guests seemed to think Iran is paying America's top schools to hate and stop Trump, they're pushing banks to decimate Americans who support Trump, and they showed a picture of record crowds mobbing DC with Palestinian flags galore in the worst antisemitic stab since WWII, and whether they have already started WWIII was listed as a concern.

Americans need to pull together and make certain we are not following Hitler's footsteps in which he killed six million jews. If we do not stop this antisemitism, we're allowing border crossers who like free money to call the shots on descendants of the Jews who funded George Washington in the person of Haym Solomon who put boots and warm clothes on his shoeless warriors, not to mention bread and butter. We must stop Iran's flow of money to cause trouble on this side of the pond. It's not a good idea to hammer the American Jewish population, keeping in mind that our Jesus was a Jewish Rabbi who taught Jewish laws to his loving followers who knew he was telling the truth about Mosaic laws being important, but not as important as the love of God for man and vice-versa, for Christ lived as though he were the prince of peace, which he certainly was, and was crucified based on false witnesses hiding their hatred and sacrilege from everyone but God and the beloved brothers and sisters of Christ Jesus, beloved son of almighty God. We must not worship the money being spent on Iran's push to rid the Israeli people from the face of the earth. That doesn't work for peace among men, and it will not benefit antisemites. The Lord God is on the side of those who protect and defend the children of Israel. The schools teaching antisemitism need a lesson if they are funneling Iran's money to support big parties on the streets of Washington D.C. A lot of that money is flowing to antisemitic reporters who support hatred of the Hebrew people, to the point of shame. This treachery is unworthy of the faith of our fathers who founded this nation. They were both Christians and Jews, and lesser numbers of people from all over this world who came to the New World to live as good neighbors in both peace and brotherhood. OK, and apple pie. :)

Those of us who support the presidency of Donald Trump are supporting the best man for the job of keeping peace on earth, my dear little small-minded friend. If you want peace on earth, vote for Trump the deal-maker. If you want constant war, keep kissin' Iran's buttboy who has made his life the vision of paying to play and the nightmare of freedom's bell that provides for the common defense and the pursuit of happiness by way of human freedom and its joy. They “seem to think”? Got any actual evidence or is this another “Hunter’s laptop” adventure?
 
It's about the Constitution, not democracy.

Section 3 Disqualification from Holding Office
No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

Don’t forget section 5 of that ammendment. That section needs to be addressed if you want to disqualify trump from office. Until then, you can’t legally do it.

But he’s not legally unqualified. You need to charge and convict him of the insurrection act for him to be unqualified.

With all the lefty hate for trump, and the myriad of indictments and criminal counts against him….why hasn’t insurrection been one of them? 18 USC 2383 is the article they need to levy if they want him disqualified.

You all haven’t charged him with the relevant statutes yet. You NEED an insurrection charge, or CONGRESS needs to enforce that article with appropriate legislation.

Until they do that, their attempts are not legal.

It's not "unclear" She specifically held the section 3 of the 1th does not apply to the President,

No conviction. Ergo, no valid application of that section even if it were applicable to the Presidentnin the first place.

No one wants to set a precedent that could then be abused by a future governing body.

It's as simple as that.

If this concept of disqualification is to survive, The Supremes will have to narrowly define it.
