They are nearly one and the same now. Most of those crossing the border from Mexico are seeking asylum which is not illegal. However, most of those that are caught who had no intention of claiming asylum do so while they are being detained. We have got to change the asylum law or this will never end.

I think the Biden executive orders that limit the number of asylum interviews per month and require that asylum seekers get an appointment for an interview using the CBP One app are helping a lot. Border encounters in August were down 77% from their peak of 249,000 in Dec 23. However, it's only a question of time before the court acts to overturn these orders. They are both illegal.

Initially, in June when we were getting about 65,000 a month, the limit was set at 41,000. This was a maximum. The actually number on any day depends on available staff. So when the asylum App is used to make an appointment the user often finds, no one available for an interview. If you do not have an appointment, you don't get an interview. At least that is way the procedure reads. However, if you arrive asking for interview and someone is available, maybe they give one. I don't know. This is the first interview you have to pass and about 1/3 do not.
