Judge Smacks Down Trump Order On Birth Right Citizenship

In the first rebuff to Trump’s attack on birthright citizenship, Senior U.S. District Judge John C. Coughenour issued an order today blocking the new executive order from taking effect for 14 days. There will be a further briefing on a preliminary injunction to permanently block the executive order while the case proceeds.

The judge gave Trump both barrels:
"I’ve been on the bench for over four decades. I can’t remember another case where the question presented is as clear as this one. This is a blatantly unconstitutional order."

 
I'm thinking that even the left understood that this is planned to go all the way to the SCOTUS. It'll be 2027 or later before it is ruled on.

What an idiot leftist leaning judge. Nobody from another country in the world should be allowed to go to America, when pregnant, and have a baby, and that baby automatically becomes an American citizen. Anyone with any common sense knows that it is totally stupid to allow such a thing to happen. :no_text11:

Frivolous lawsuits like this one brought by activist blue state AGs that are acting for non-citizens should carry a financial penalty on the state and the AG or governor personally. These elected officials have NO STANDING when it comes to illegal immigration and the circumvention of US law.

Yes, but I'm pretty sure that it has been planned for.
 
My nephew was born in Germany and was considered eligible to all rights and responsibility of a citizen. After my brother was discharged from the army and moved back home my nephew at the age of 17 and just graduated high school got a letter from The German Government, it was his Draft Notice:) It took going to our local U.S. Congressman office to get it straightened out. So It does happen. It can be a good rule for some . I am watching BBC news and one of the gentleman is saying it doesn't happen anywhere else but it does. Donald Trump, JD Vance's wife, Kamala Harris would not be citizens under Trumps order they are saying.

The SCOTUS may refuse to take it up. This issue was decided already in the 1800's. If anything, they have always deferred to the Congress, not the President, on these type issues even when there is a dispute about meaning.

I don't fault the judge for ruling that way. If that's how he sees the case, he gets paid to be a first line judge, so to speak.

Clearly, he's far too low on the judicial totem pole to believe that he can make stick a ruling stoping the POTUS from doing exactly what he was elected to do.

OR maybe he does think that. Here is how he tried:

But it won't work. He thinks that by making that statement, he makes it harder for higher courts to overturn him. Won't work. Tthat kind of overwrought and overly dramatic language is not going to sway the higher courts, and certainly not he USSC, where this is soon headed.

Seriously, was he waving his hands or jumping up and down when he said all that? Maybe stomping his feet?

The American people are just rolling their eyes at more virtue signal grandstanding by someone they never heard of getting his or her five minutes of fame by attacking the man they overwhelmingly just now elected to the White House.

IMO moron's playing right into what Trump wants. This can now go to SCOTUS (which was the sole reason he signed the EO), and if they uphold the EO and rule that the 14th amendment does not grant birth right citizenship it stays that way for the foreseeable future. If no action is taken the next President can overturn that EO with an EO of their own. Won this fight but put the war in the balance.

That aside, I'm not sure why anyone thinks the way "birthright citizenship" is being used to circumvent the legal immigration system is a net good for the US.

We all know it’s going to the Supreme Court.

Just to note, this "idiot" judge was appointed by Reagan.
