In order to seek the death penalty, prosecutors needed to show that Mangione killed Thompson while committing another “crime of violence.” Stalking doesn’t fit that definition, Garnett wrote in her opinion, citing case law and legal precedents.

comment: I guess if you want to murder someone, NYC is the place to go....

Money talks.

If he had been a poor kid raised in a trailer park or the ghetto, he would probably have already burned his first appeal for murdering a CEO.

Garnett was recommended to the White House by Senator Chuck Schumer.[5] On June 28, 2023, President Joe Biden announced his intent to nominate Garnett to serve as a United States district judge of the United States District Court for the Southern District of New York.[2] On July 11, 2023, her nomination was sent to the Senate.

Or go to California. Thursday in TX, a man was executed for killing his former girlfriend and her boyfriend. I suspect were that the judge, he would still be alive.

Meh, he can be "dreamy" at ADX Florence Super Max for the rest of his life.

I figure he will spend most of it in here:

Hell, if he was an illegal, he'd be out on the street already.

Either this judge is an idiot or the law is utterly broken. Premeditated assassination should most certainly warrant the death penalty. That is not a behavior we can afford to reward by removing the harshest punishment.
Agreed. Hell, they have him on video doing it!

I wonder how many defense attorneys are going to ask for a new hearing for their claimant based on this judge's decision.

Yep. His only mistake was failure to renounce his citizenship before the assassination. Democrats would scorch the nation for him if he is an illegal alien.

So now we cannot execute unhinged murderers unless they were committing another crime at the same time? Once again, our justice system cannot get out of its own way in protecting the individual regardless of the impact on society at large, so we are now a country filling up with criminals on the streets while we go broke trying to house the rest for life in prison.

Lethal injection: $35

House prisoner for rest of life: est. 2-5 million.

Yeah, I don't get it...How in the holy f**k can a seemingly educated person, elevated to the level of a Judge, hear what's coming out of her mouth here, and say to themselves, yeah, this person cold blooded murdered this man, but, capital murder is out of the question....Maybe a ticket for littering from the brass falling on the sidewalk....Jesus.
