If small business owners re-open their businesses as "peaceful protests" of the government lockdown, does that make it legal?

As long it is a "peaceful protest", you can pack together in giant mobs and the gathering itself is not illegal. They are only arresting protestors who are breaking actual laws such as theft, vandalism, and assault.

This gathering is itself not illegal. In fact, that mob can legally surround you and they will only be arrested if they get physically violent.

This guy gets arrested for opening his business during the lockdown because people might voluntarily enter his business of their own free will and risk contracting a virus with a death rate of .3 percent. I guess he should have been out rioting instead of providing jobs and being a positive force in his community.
