They are also guilty of obstruction of justice and in violation of Section 1324 Title 8 of the US code which makes it a federal felony to encourage illegals to live here. And for that they can be legally executed !!!

Thomas Homan, ICE chief, says immigrant ‘sanctuaries’ break smuggling laws

july 26 2017 The country’s top immigration enforcement officer says he is looking into charging sanctuary city leaders with violating federal anti-smuggling laws because he is fed up with local officials putting their communities and his officers at risk by releasing illegal immigrants from jail.

Thomas Homan, the acting director of U.S. Immigration and Customs Enforcement, also told Americans to expect more work site enforcement targeting unscrupulous employers and more 287(g) agreements with willing police and sheriff’s departments that want to help get illegal immigrants off their streets.

Mr. Homan is the spear tip of President Trump’s effort to step up immigration enforcement — perhaps the largest swing in attitude for any agency in government from the last administration to the current one.
Agents and officers have been unshackled from the limits imposed by Mr. Obama, whose rules restricted arrests to less than 20 percent of the estimated illegal immigrant population.

ICE has no authority to do that.

and Homan isn't "ICE"... he is just one of Donald's loons who has no sense of the limits of their authority.

you're welcome

Federal agencies have charters, those outline the responsibilities, and authority of the agency. The IRS for example, is empowered, and authorized to investigate tax related crimes. The IRS would be ill suited, untrained, and unauthorized to search for drugs. That is the DEA's bailiwick. On the other hand, the DEA would be laughable at trying to find tax cheats.

Yet, they are both federal agents, so why can't they enforce any old federal law they want?

Now, that would be funny. The Government arrests the people in charge, and then the Government tries them, and the jury finds the accused not guilty. What then? Do you stamp your foot and demand that they go to jail anyway?

What jury would say not guilty??? For example there are agencies such as ICE trying to enforce the laws against illegals living here while obama gave millions of illegals a certificate that tells them they can stay!! Do you really think a jury would say obama did NOT commit obstruction of justice???? THINK

Yes. It's why the Feds are so upset at states with legalized marijuana. The DEA can still arrest people. The US Attorney can charge them and try them. Then the jury can and does find the defendants not guilty.

Now let's say you arrest the Mayor of San Francisco. Then a jury of people who are from and live in San Francisco decide if the Mayor is guilty. The people there support the Mayor, and that means they can, and will find the Mayor not guilty. What do you do then? You can't try the Mayor again, double jeopardy. So then the Mayor gets to hold the victory fist up and then what can you do?

All you can do is demand they stop what you don't like. You can try them, and when they are found not guilty they can then laugh at you. Local juries don't always see it the way you want.

Rules are different for Juries in Federal Court to include how they are selected. The fan boys and girls would be prevented from being seated.

Yeah. That has worked in the past. Locals have different ideas.

Jury finds all 7 wildlife refuge occupiers including Ammon Bundy not guilty on all counts

A federally empaneled jury found them not guilty. Local sensitivities often trump the federal authority.

You don't understand the law, you fool. The jury is NOT going to unanimously vote not guilty. One or two of the jurors might but then it's a hung jury and he's tried again. You don't know what double jeopardy is.

It is not smuggling if they issue IDs.

Double jeopardy is when you are acquitted and tried again. Hung hue is not. You are right about that. But if you think you are getting a guilty verdict in California you are nuts.

Not guilty is just short of certain.

You seem to think most californians support illegals. I don't believe that. Sure - the press says they do just like they told us trump didn't have a chance of winning last november. But most americans, left and right, realize it's crazy to let other countries dump their welfare trash on america and they want amnesty and sanctuary cities to end.

The rub with your theory is this. The politicians that ICE hopes to target and intimidate with this, are elected. Elected by the population of the state. Elected by the populations of the cities. This was an issue during the last election, and they still got elected. The people voted for them despite knowing how they felt. And the elections weren't even close. These amnesty politicians won by large margins generally speaking.

You are making the mistake that the people on the left make all the time. Assuming that because you and a handful of friends near you, and some people on the internet agree that most people do.

This is where regional differences come in. I've said it before, by Georgia standards, especially rural Georgia standards, I'm pretty liberal. But by San Francisco standards, I'm a RW nut. I recognize that people in other areas have different views. It's a shame you don't.

The Mayor of San Francisco won with 55% of the vote. San Francisco mayoral election, 2015 - Wikipedia

Now, you can stomp your foot and say all the illegals voted, or whatever. The point is that these politicians were elected, by majorities. Even those who were beaten, most had similar views. Now, your challenge as a prosecutor is to get a jury where you can win. How do you do that? Do you honestly think that twelve random people in San Francisco are going to agree to send the Mayor to prison for the trumped up charge of smuggling?

It's a cudgel. The Feds have no intention of doing it. They know they won't win in court, they know the best they can hope for is a hung jury. Why fight a battle when you know the best you can hope for is a tie?

Besides, what are these "sanctuary" cities actually doing? They are refusing to assist ICE in their raids. They make public statements that ICE is a bunch of thugs etc.

Would you like it if the local police were enforcing federal Tax laws? Would you like it if the local police were enforcing any other federal law? I distinctly remember the Conservatives shouting about Sheriff's enforcing Federal Law when the Brady law was passed. Those conservatives rightly argued that expecting local law officers to enforce Federal law violated the tenth amendment.

Printz v. United States - Wikipedia

Now, explain to me why the Brady Law which expected the local Sheriff's to conduct background checks was a violation of the Tenth Amendment, but expecting local cops to enforce Federal Immigration law is not.

I'm waiting. Because no Conservative has ever explained it, or even taken a swing at explaining it.

The fact is that states and local governments are not charged with enforcing federal immigration laws. They cannot be forced to do so. Filing charges would be the equivalent of what Putin does in Russia.
