Looking at the video I am not going to say that. Both looked to be at fault. It could have been intentional but it also could have been not reacting in time to the ICE vehicle pulling out. (edit: Chicago not California) is absolutely full of terrible terrible drivers...
I don't believe the video alone is conclusive enough either way. Other evidence would be necessary.

However, it in no way looks like the ICE vehicle was "bailing," etc. It looks like they cleared the wreck a few feet and came back. Frankly that was a pretty rough hit and I hope no one was actually hurt.

No proof of any of that. All you have is a film and a narrator, who may have been there talking or dubbed in later, we have no context at all, so unless real video emerges and we see both sides it is silly to assume anything.
