Federal Court Rules That Gay Couples Have Constitutional Right To Marry

DENVER (AP) — A federal appeals court ruled for the first time Wednesday that gay couples have a constitutional right to marry, extending the movement's legal winning streak and bringing the issue a big step closer to the U.S. Supreme Court.

The three-judge panel in Denver ruled 2-1 that states cannot deprive people of the fundamental right to marry simply because they choose a partner of the same sex.The court dismissed as "wholly illogical" the notion that allowing gays to wed could somehow undermine traditional marriage.

True, given the fact same-sex couples enter into the same marriage contracts as opposite-sex couples.

The issue needs to both go in a different direction and move out of the kangaroo courts.

No a far left blog site disagrees with me.

Point to it in the Constitution.

Marriage is not a "right".

Government should not be in the marriage business.

It's hard for those embracing feudalism to understand that the current year is 2014. BUY A CALENDAR!!!!

Well since the Government IS in the marriage business it would be unconstitutional to only allow heterosexual couples those privileges that every citizen pays into.

Only time and the USSC will tell; as there is a definite denial on the establishment of religion in the Constitution, what are the arguments against? :It has always been that way"? Rings hollow.

Yes! And that is certainly GREAT News!! The courts are realizing more and more that Gay Citizens cannot be denied the right to marriage equality under the Fourteenth Amendment and virtually all courts are striking down Same-Sex marriage bans across the country! And why not? Gay citizens work, pay their taxes, worship in church, raise kids or adopt, and they vote! So why wouldn't they receive the SAME rights as everyone else? The courts now know that it is wrong to keep denying them those rights that they should have had automatically since day one and are now moving to correct that court by court and the trend can only Continue!

it isn't..If it were, there would be no state sanctioning. No license requirement.
And please, do not ever believe that rights are absolute.
I say let 'em get married. Let them deal with the bullshit. The arguments, the eventual split up( 54% of the time) then the property disbursement. Who gets the house. Who gets stuck paying for the house. Blah blah blah.
I've been married 28 yrs. I'm lucky. Almost every one of my friends has been divorced at least once.

Incorrect.

The right to marry can be found here in the Constitution:

More recent decisions have established that the right to marry is part of the fundamental "right of privacy" implicit in the Fourteenth Amendment's Due Process Clause. In Griswold v. Connecticut (1965), the Court observed: "We deal with a right of privacy older than the Bill of Rights - older than our political parties, older than our school system. Marriage is a coming together for better or for worse, hopefully enduring, and intimate to the degree of being sacred. It is an association that promotes a way of life, not causes; a harmony in living, not political faiths; a bilateral loyalty, not commercial or social projects. Yet it is an association for as noble a purpose as any involved in our prior decisions."

Cases subsequent to Griswold and Loving have routinely categorized the decision to marry as among the personal decisions protected by the right of privacy.

Signing a will and some different legal documents can take of those things.

Other than plundering someone's social security what else does the gay agenda have?

It is funny when the far left will not accept they are far left even when they accept the far left religion without question or hesitation.

The far left openly hijacked the Dems back in the late 70's when they took down one of their own (Carter) when he dared to stand up to them.

Ever since they have been on their path of destruction that is more dangerous than any terrorist origination on the planet.
