Yep, the supremes punted it down to the lower courts.

Waiting on the "plain english" description over at SCOTUSBLOG, but what it appears happened is the court is looking for plans that actually show they increase diversity, instead of just making diveristy a goal and not observing any implied affects.

Refusing to take the case would have let the lower court ruling stand. What SCOTUS did was send it back with a note saying "think about this for awhile".

So basically they didnt like how the topic got to them, want the 5th to re-issue, and see if the parties involved still want to pursue it.

I certainly hope so. AA should be based on need & ability not skin color. This was the perfect case to see the need for that change but they punted.

They had a very similar case in '03 and they ruled on the AA side. So punting isn't such a bad thing

AA is hugely offensive. The idea pits one's outcome against another's race, ethnicity, color.... Its appalling and its hard to believe that we have such offensive laws.
