As protests around the country are increasingly met by gun-wielding antagonists, a federal judge allowed California on Monday to maintain its near-absolute ban on openly carrying guns in public, but refused to dismiss a suit challenging the ban.
The ruling stood in contrast to the angry confrontations that flared up elsewhere last week, as right-wing extremists came to protests with guns and asserted their right to openly carry. California has so far not seen those kinds of armed conflicts at protests.
In Monday’s ruling, U.S. District Judge Kimberly Mueller of Sacramento noted that the U.S. Supreme Court’s 2008 decision allowing private citizens to keep handguns at home for self-defense declared that the Constitution’s Second Amendment was intended to allow Americans “To use arms in defense of hearth and home.”
Although the high court has not yet ruled on whether Americans have a constitutional right to carry guns outside the home, the court denied review in 2017 of a Ninth U.S. Circuit Court of Appeals ruling upholding a California law that prohibits carrying concealed weapons in most urban areas, including San Francisco.
Oh god please cue the heads of exploding Cons over this. Under California Law it is against law (as affirmed by Judge Mueller) for any individual to openly carry a firearm.
