I believe Trump was referencing that report made by Biden's own administration, which said Biden's mental capabilities were so diminished, he could not be prosecuted for mishandling classified materials. That report certainly justifies Trump's decision.

The docs case wasn't the case that was going to send Trump to prison. In fact, I considered it a waste of Smith's resources.

President Trump didn’t have to give anything back because he declassified all the documents he wanted. You forget he let the FBI in to examine the documents in the first place. If there were any classified documents, it would had been illegal for the FBI to leave them there. Instead they didn’t take anything. There has never been any proof that there were classified documents he wasn’t supposed to have. Being a former President, he still holds a security clearance and gets intel briefings.

Biden on the other hand, had those documents since he was a Senator and a VP. He was never entitled to have them in his garage.
