To be factual, (it is Fox news so..........) he is not being threatened with jail time. He was being warned that untruthful statements could lead to jail time (not that it hardly ever does).

Taibbi did make a false statement but he quickly noted he mixed up two groups and amended his statement. No one is going to prison over it.
