The Lawyer's job is to present the argument - their argument was that the ACA contained a PUNATIVE FINE
The COURT'S job is to determine if that legislation is Constitutional.
Kennedy pointed out that the SCOTUS heard the government's / lawyer's argument and came to the decision that they were WRONG, that a 'punative FINE' was UN-CONSTITUTIONAL... and at THAT point Roberts over-stepped his authority by CHANGING THE GOVT LAWYER'S ARGUMENT.
