march 5 2025 A Chicago landlord has been instructed to pay more than $80,000 to a tenant couple after he threatened to call Immigration and Customs Enforcement on them.

Marco Antonio Contreras and his wife, Denise Contreras, were the first people to be charged under the 2019 Immigrant Tenant Protection Act. The law forbids landlords from evicting tenants solely because of their immigration status or otherwise threatening to report tenants' immigration status to threaten or retaliate against them.
The couple praised the ruling in a statement.

“We decided not to stay silent because our landlords threatened us with calling immigration, and we do not believe that anyone has a right to threaten us,” the couple said in the statement. “No one should feel or act superior to others. We are all equals and deserve respect. Just because someone is your landlord does not mean that they get to do whatever they want to you.”

In the case of the Contreras couple, the tenants filed the lawsuit after the landlords threatened to report them to ICE if they didn't pay the desired rent by a certain time.

Yeah this isn't just a normal ask for rent it's definitely using the disadvantage of the immigrant couple against them for money. Having said that there's nothing from preventing the landlord from calling Tom Homan....

That's the thing. Where a lot of people fall into the trap is when you bounce a check. They can have you prosecuted or they can sue you, but they are not allowed to say pay me by Friday or I will have you prosecuted else you can have them prosecuted too.

But you can start the eviction process as outlined in the lease contract. You're not allowed to simply move into a place, sign a contract that you will pay a certain rent to live there then refuse to pay and refuse to leave.
