Capitol riot defendants face upheld trespassing charges in US court

A U.S. appeals court on Tuesday upheld the use of a criminal trespassing charge against nearly all of the 1,500 defendants accused of taking part in the Jan. 6, 2021, attack on the U.S. Capitol, rejecting an attempt to further restrict the charges available to prosecutors.

In a 2-1 ruling, a panel of the U.S. Court of Appeals for the District of Columbia Circuit rejected an appeal by defendant Couy Griffin to toss out his conviction on a misdemeanor charge that bars unauthorized people from entering restricted areas protected by the U.S. Secret Service.

Because the brave Mike Pence was in the building with a protection detail, any terrorist who breached the barricades and invaded the Capitol on January 6 is subject to a charge of trespassing in addition to any other crimes they committed that day.

These are not "political prisoners". These are animalistic terrorists who bludgeoned, stabbed, electrocuted, pepper sprayed, stomped, and wounded at least 140 uniformed men in blue that day. Trespassing is the least of the violent, vile, and vicious things they did.

You are seriously fucked in the head if you think someone who beats and electrocutes a police officer into a heart attack is a "political prisoner".

Seriously. Fucked. In the head.

Every single person charged with trespassing did that?

99% of the protesters were peaceful and were escorted into the Capitol by police. Your hate is blinding you. If you are so concerned about insurectionists, why aren't you asking why the FBI isn't even looking for the main instigator, the man in the media tower urging people inside the Capitol? He is not even on the Most Wanted list. I'll tell you why. Because Feds instigating the crowd ruins your fake narrative. Waiting for your answer.

I'm pretty sure you will ignore this because you are a fraud and a hater not interested in the truth. But everyone else will notice you ignored it so the truth is out. Your welcome for making you look like a fool.

The majority of these folks should get no more than the establishment typically give folks in "Code Pink."

Anything else, yeah, is a political move.

". . . Benjamin says that the activists launch their actions knowing full well they face arrest - and that knowledge frees her psychologically, for example, to berate the president of the United States for authorising drone strikes in Yemen before an international television audience.

"We don't like getting arrested - it takes time and it's expensive and takes lawyers," she said. "But we've been arrested dozens of times."

Benjamin has also been denied entry into Canada and Egypt, where she says an Egyptian policeman fractured her shoulder attempting to force her onto a plane out of the country.

But in Washington, the Capitol complex and committee hearings are by law and democratic tradition open to the public unless secret intelligence matters are being discussed.

The police who guard the Capitol complex will not ban serial disrupters from the premises unless a judge deems extraordinary circumstances warrant it.

"The US Capitol Police respects and protects the right of people to peaceably assemble and exercise their rights under the First Amendment" to the US constitution, spokeswoman Lt Kimberly Schneider said in a statement. "We balance providing security with maintaining a safe and open campus that is accessible to the general public."

In 2007, for instance, a Code Pink activist was charged with disorderly conduct and assault on a police officer and banned from the Capitol premises after she waved her red paint-covered hands inches from the face of then-Secretary of State Condoleezza Rice and shouted "war criminal".

And last year, a judge controversially banned an anti-abortion activist from entering Washington for a month after he climbed a tree during Mr Obama's 2012 inauguration, shouted anti-abortion slogans and for five hours refused orders to descend. . . "
<snip>
". . . Their names are run for outstanding warrants, and they are either told not to re-enter the hearing or, depending on the rules of the committee and the specific behaviour, arrested and charged with disruption of Congress or another violation.

But by and large, Benjamin said she and her fellow activists have a sort of working relationship with the officers, who often greet them cordially as they wait in line outside a hearing room in the morning.. . . "

Why protesters Code Pink stay out of jail

". . . After all the investigating, only one person was taken into custody in connection with the bombing. She was a tall 19-year-old blonde from California named Leslie Bacon, who had been helping book musicians for the rallies. The FBI found witnesses who said they saw Bacon in the Capitol the day before the blast. When she denied it, she was charged with lying to the grand jury. Weather wrote an open letter to Bacon’s mother, saying she was innocent: “Mrs. Bacon, we cannot turn ourselves in to save Leslie. She is a committed revolutionary and understands this.”

At least a dozen other activists were subpoenaed before grand juries in New York, Detroit and Washington. All refused to answer questions. Some taunted the feds, like Judy Gumbo Albert, the driver of the car stopped in Pennsylvania, who declared of the bombing: “We didn’t do it, but we dug it.” Prosecutors had to decide whether to bring Bacon to trial anyway. But by the time the matter came up, the Supreme Court had issued a decision that effectively would have forced the government to disclose details of its surveillance. The Watergate burglars had just been caught, and the last thing the administration needed was another bugging scandal. Nixon himself ordered the Bacon case dropped. She and the other activists went free. Bacon has continued to say she had nothing to do with the bombing. . . ."

One of my favorite rioters comes from my part of Pa. Rachell Powell has 8 kids, no husband and no job but she managed to get her dirtbag butt arrested. She wanted to destroy the government who feeds her and her trashy family.

Your propagandists have finally found a video of a handful of terrorists allowed into the Capitol by the police, knowing you will willfully ignore the hundreds of hours of video of HUNDREDS UPON HUNDREDS of their fellow terrorists smashing windows and doors to get in, and in one particular hallway striving for hours to stampede the thin blue line protecting that entrance.

You will ignore the 140 injured police officers, too. Because you are a weak-minded rube with a selective memory of the events ALL of us saw that day.

And finally, those terrorists in that video had to smash through the police barricades to get there, but you don't give a flying **** about that, now do you.

According to the indictment, Powell stormed into a restricted section of the U.S. Capitol carrying an ax and a large wooden pole. She allegedly destroyed a window in her path, costing more than $1,000 in damage.

Court paperwork says Powell was with a group inside the Capitol and provided detailed instructions on the building's layout, telling rioters that they should "coordinate together if you are going to take this building."

Federal prosecutors have called Powell a "leading participant in the most violent insurrection to occur at the U.S. Capitol in over 200 years," and said she "fueled a situation that threatened the peaceful transfer of power in the United States.

But you will still say it is baseless charges.

Walking around Capitol grounds is illegal for Trump supporters and gets you endless incarceration on fluff charges or
worse-murdered

‘I hope you suffer’: Ex-D.C. officer confronts Jan. 6 attacker in court

A member of the mob that launched a series of violent attacks on police — including D.C. officer Michael Fanone — in a tunnel under the U.S. Capitol on Jan. 6, 2021, apologized Tuesday as a judge sentenced him to seven years and two months in prison.

Kyle Young, 38, is the first rioter to be sentenced for the group attack on Fanone, who was dragged into the mob, beaten and electrocuted until he suffered a heart attack and lost consciousness.

“You were a one-man wrecking ball that day,” Judge Amy Berman Jackson said. “You were the violence.”

[snip]

Young and his 16-year-old son joined the tunnel battle just before 3 p.m., and Young handed a stun gun to another rioter and showed him how to use it. When Fanone was pulled from the police line, Young and his son pushed through the crowd toward him.

Just after that, authorities said, another rioter repeatedly shocked Fanone with the stun gun, and Young helped restrain the officer as another rioter stole his badge and radio.

Young lost his grip on Fanone as the mob moved. He then pushed and hit a nearby Capitol Police officer, who had just been struck with bear spray, according to documents filed with his plea.

Young also pointed a strobe light at the officers, jabbed at them with a stick and threw an audio speaker toward the police line, hitting another rioter in the back of the head, prosecutors said.

At 6 feet 6 inches and nearly 300 pounds, the force of Kenneth J. Bonawitz launching himself through the air and slamming his forearms into the throats of two police officers standing below him during the Jan. 6 Capitol riot must have been enormous. One officer suffered back injuries such that he was forced to retire in permanent pain.

BLUE LIVES MATTER!

Bonawitz, 58, wasn’t done. As other officers rushed in, they spotted an eight-inch hunting knife on Bonawitz’s hip and seized it from him. But the police were too overwhelmed to arrest Bonawitz and returned him to the crowd on the Capitol’s West Terrace, where he proceeded to fight with more officers, including putting one officer in a chokehold and lifting her off the ground. He ultimately assaulted six officers before retreating after being hit with chemical spray. Prosecutors called him “one of the most violent Jan. 6 rioters” and said his attacks “were barbaric and left his victims with lasting physical, emotional and psychological injuries.”

This was all caught on video, but you won't see the lying MAGA media airing it. They are masters of the lie of omission.

There is no bottom to the alternate unreality and evil of MAGA's brainless parroting schizos.

They just subtract facts like that from their thought processes. Poof, gone.

Jury Convicts Four Leaders of the Proud Boys of Seditious Conspiracy Related to U.S. Capitol Breach

Most of these Trumptards in jail were so ******* stupid, they filmed or photographed themselves storming the Capitol, battering the police, stealing government property, and destroying the place.
