Bowe Bergdahl to face general courts martial for desertion

I don't disagree with his treatment. I think he should get the min of 20 to life that goes with the crime. And that is probably what he will end up with. They offered him an out, he didn't take it. He made the choice to open his fat mouth. Right or wrong, he decided to continue his fight and now he has to pay the price. Sometimes, it's worth the time. I don't judge him on that. I do find that his leaving like that where he could be captured without a fight is .......well.........

During Vietnam, we had people desert in country as well. Every war has them. Most of the time, it's a moral judgement that causes this. This is the first time I have heard of someone in a combat area go over the hill because the CO didn't say please enough times.
 
Is that how our military justice system works, keep your mouth shut and don't embarrass anybody or you face greater punishment than the original crime called for? Is that embarrassment thing written in the military code along with the penalty for embarrassing?
Maybe that's in the code of politics not in a code of justice? Maybe the military is embarrassing itself with this kind of nonsense?
The court of public opinion has forced their hand. Now it'll go straight up Obama's ass :lol:
 
It's not the public that is driving this. The Military would have been happy for time served, reduction in rank, forfieture of pay and a Bad Conduct Discharge. But he ran his mouth and wouldn't shut up. So they withdraw the offer. It's sort of like a felon that states that he's not going to reform and will continue his trade as quickly as possible. He blew it. If they were willing to offer the lesser they have him on the greater as well. '

The ONLY way that he can the General Court Martial overturned is for Congress to overturn it. Good friggin luck on that.

He is going to spend a lot of time talking to himself in Leavenworth Prison. He can run his mouth for at least the next 20 years and no one will listen.

As for your Re-Elect No-One, I would like to see an addition to each candidate. None of the Above. All we have to do is vote it onto the ballots and it becomes a law. If 36 states do this then it can become the law of the land. Imagine the first couple times that they have to have another election where both Dem and Rep candidates are barred from running in the new election for that office.

Staff Sergeant Michael Murphrey, 25, of Snyder, Texas,died Sept. 6 in Paktika province after being wounded by an IED. Like Bergdahl, Bowen, Walker, Curtiss and Andrews, Murphrey was part of the 4th BCT.

“On his 17th birthday his family took him skydiving and after that,” his obituary read, “he decided he wanted to be an Army paratrooper.”

The U.S. military rushed him to Landstuhl Regional Medical Center in Landstuhl, Germany—the same medical facility where Bergdahl is now being treated

Their is no honor with the leftist

If the general changed the usual way this case would have been handled why did he change, and had he asked for these changes before Bergdahl or only for Bergdahl's trial?
 
Despite leaked stories to the NY Times from Bergdahl's defense attorney indicating that he would face only a "special courts martial" with the probability of time served it seems the fat asses in the Pentagon finally caved in to pressure from the public and Veterans groups and Bergdahl will be tried by general courts martial and if convicted might face 20 years in prison. A conviction would offer some closure for the families of the heroes who lost their lives looking for a deserter. . Doesn't it fly in the face of Obama's ceremony in the Rose Garden with Bergdahl's parents? You have to wonder if the president is on the same page with normal Americans or if he understands the proud tradition of the U.S. Military or he is suffering from "dreams of his father" and words from his seriously disturbed Pastor and he really hates this Country.
Under UCMJ he could face the death penalty for desertion during a time of war, but that's never going to happen.
 
Bergdahl was arraigned at Ft. Bragg today (tuesday) on charges of desertion and misbehavior in the face of the enemy. Apparently he requested a combination of military and civilian lawyers. Will the Hussein administration put pressure on the Military jury? I wouldn't doubt it. If convicted of the most serious charge he faces life in prison.
 
Some days "you eat the bear" and others "the bear eats you". What else is new? Obama still has time to pardon Bergdahl after the Courts Martial, if he so desires. It is not over, till then. As for myself, I "just continue to march", day in and day out! As all of you do. Now move out and maintain your distance, no twofers today!
 
The Court should not be swayed by politics, politicians, the media, the public nor other factors, it should decide as it usually decides.

Sometimes, a jury already has their mind made up ; sometimes a jury believes they know the story and facts, the court case is just an impropriety - The Jury is simply passig time till final deliberations are over to hand down a sentence.

This may be one of those cases.

The first time I showed my ignorance, the lieutenant told me to drop the prisoner off at the stockade after the trial. When I suggested the court had not even decided yet he looked at me like the boob I was. In a short time I dropped the prisoner off at the stockade to begin his sentence.

Where I am from - Lawyer "A" and Lawyer "B" meet, lunch, dinner and talk the case over before they even step in the court room.

In some cases, where I am from....you have to go a hundred miles away to get a good Lawyer that does not meet and talk about your case....."who gets what" / "What is going to happen".

Some small town counselors around here will "B-S" you about your case - they made a deal with the opposing Lawyer.

Yeah......It happens.

It is when your legal counsel is not forthright and honest with you about your case, or they intentionally neglect to give you an option or legal opinion. Or the deal is worked out so one of......OR both lawyers benefit. Criminal or a tort case.

Just because one is a Lawyer, does not necessarily mean they are right. Lawyers......like Police Officers, Accountants, Federal Agents, Doctors, and others......are not all the time necessarilly right. Neither are lawyers. Lawyers make intentional.....and unintentional mistakes. Not all are honest and weighed down with integrety.

Lawyers do get reprimanded.....and some even get disbarred.

dude, if your lawyer commits an ethical violation, report them. again, it isn't a conspiracy. they should be talking.
