The judge ordered testimony from two of the top DOJ lawyers involved in the March deportation operation.



A federal judge is escalating his inquiry into whether Trump administration officials deliberately flouted his March 15 order to prevent immigration officials from delivering more than 100 Venezuelan men to a notorious prison in El Salvador.

James Boasberg, the chief judge of the U.S. District Court in Washington, said Monday that it’s “premature” to recommend criminal prosecution of Homeland Security Secretary Kristi Noem, who revealed last month that she gave the order to turn over the men to Salvadoran authorities on the advice of administration lawyers.

Boasberg is now demanding that two of the top Justice Department lawyers involved in the March deportation operation — including one who has since been fired for resisting some of the administration’s moves — appear for questioning next week."




Boasberg appears to be heading the Democrats' shadow gov't. Now, he's his own executive branch investigating the democratically elected executive branch. Who elected Boasberg?

He was appointed as a federal judge. This means his judgements are binding. This includes binding to the executive branch.

Again, if you want a government that has only one branch of government without any checks N-Korea is lovely this time of year I heard.
 
Federal district judges ignore the separation of power.
The Executive branch should IGNORE FEDERAL DISTRICT JUDGES.

I don’t think ‘separation of powers’ means what you think it does.

Separation of powers doesn’t remove the judiciary’s authority, it creates it.
It exists so each branch can limit the others when they overreach.

The executive executes the law.
The judiciary interprets the law.
If the executive can simply ignore judicial rulings, then there is no separation of powers, that’s the exact situation the doctrine was designed to prevent.

In other words:
If you want the executive to be able to disregard court orders, than what you’re describing isn’t separation of powers. It’s the abolition of judicial review.

What if the court order is not legal upon examination ?
Then the government can execute it's policies.

In this case the executive branch has tried to thwart the contempt proceedings by appealing. That appeal was rejected. Meaning it went back to Boasberg. If he rules it will be undoubtedly be appealed again. Almost certainly all the way to the Supreme Court.

What the government can not do is simply say. "We don't agree judge and will simply ignore your ruling." There's a process. A process that you, me and the government has the follow

It is their duty not to carry out illegal ordere.
And to carry out a legal one !
I love how you guys blather about (il)legal orders, while at the same time rejecting the process by which the legality of orders is established.

There's a name for a government that has one branch that makes the law, executes the law and determine the legality of those laws. It's called autocracy.

What do you imagine happened? Boasberg got out of bed and he just decided to take the case?

This is his lane. When Trump invoked the Enemy Aliens Act the case went to the federal level. If Trump wanted to deport people using the usual administrative route he could have just used the usual administrative procedure, and thereby getting rulings from immigration judges.

Pro-tip if you don't want the federal courts involved don't invoke war time powers.
