"We again ask that Donald Trump cease his prejudicial months-long campaign of defamation against our client," Fidell said. "We also ask that the House and Senate Armed Services Committees avoid any further statements or actions that prejudice our client's right to a fair trial."

Will it affect the outcome of the trial? Doubtful. Any officer involved will understand that the convening authority – General Abrams – decided to take this to trial and will act in accordance with the USMJ. The defense is simply playing to the grandstands and I don't think it will work. Bergdahl will spend a lot of time in Leavenworth.

He's crying about the House Armed Services Committee chairman saying they would keep a close eye on the proceedings.
 
Court room antics happen in a Military court, like a civilian court.

Intimidation, overbearing, the accused being charged with crimes they did not commit, perjury, manipulation of evidence.

I know, I was in the Military and knew Military lawyers.

Military lawyers face reprimand and other punishments for ill deeds, and poor legal work, just like civilian lawyers.

Some US Military Lawyers, are also very poor investigators. They fail at cross examination, they fail at research. And in the end, some Military defense lawyers..... Some of them; still look and act at the best interest of the US Governments case. They all get paid by the same employer.

Media antics and games is going to occur. Trial by jury and sometimes the public trial is going to occur.

I have my thoughts, but SGT Bergdahl deserves a competent defense team with integrity to make sure the US Government does not mess him over or " railroad " him.

My former boss - a Full bird Colonel was asked at the court martials I took him to, the question about being impartial and yada- yada - yada. He said no. So he was excused from serving on a Military jury. My boss believed that all Soldiers whom done wrong should pay 10 times what they were guilty of.

He was just one that i knew of.

US Military courts are not perfect or immune to improprietys and other wrong doing.

A defense team, competent and with integrity ; whom believe in their case and are not swayed in their beliefs.

Bergdahl will face neither a civilian nor a military court, he will face a political court. What decision a military court might have found, had this been a routine case, has long been gone, politics will now decide.

People have a right to their opinion but does Trump have the right to use his presidential podium to change an individual's right to a fair trial into a political trial based on Trump's politics? Why couldn't Trump just keep his pouting bazoo out of the trial until it was over and then ventilate his opinion? Now Trump has his followers chanting guilty, guilty and the military Court takes note. Trump just might be their next commander-in chief and why take chances on justice, compared to that?
 
Wouldn't you think the defense attorney in a General Courts Martial would welcome input from civilians in congress?

i disagree. even the most well-meaning person can be pressured and swayed by the constant braying. it isn't the right thing to do just because they think it is a way to snipe at the president.

if a republican had brought him home, they'd be saying he's ours to try... you don't leave behind a marine.

but it was this president who brought him home so they haven't stopped.

just my feeling on the subject.

"The Army announced on Monday that it would try Bergdahl for desertion at a general court-martial, a decision contrary to the advice of the preliminary hearing officer who interviewed Bergdahl and other witnesses, Fidell said. The preliminary hearing officer, Lt. Col. Mark Visger, recommended in October that the charges against Bergdahl be referred to a special court-martial but that "a punitive discharge and confinement would be inappropriate given all the circumstances,"

Sounds like the opinion of a Lt. Col. was over ridden. Public pressure would be a pretty good guess as to why. In the case below a Captain made the decision not to Court Martial but there was no public outcry for "justice";

"In 2012, U.S. soldiers told Navy SEAL command that they saw SEALs and Afghan police they worked with brutally beating detainees, according to the New York Times. They dropped stones on prisoners’ chests, stood on their heads, poured water on their faces, kicked them, and hit them with antennas and rifle butts. The abuse was so severe that one of the prisoners died within a day."

"SEAL Capt. Robert E. Smith, then in charge of SEALs based on the East Coast and who is now a military assistant to the secretary of the Navy, told the Times that he found inconsistencies in the soldiers’ accounts during questioning five months later and that conflicting statements from Army and Navy witnesses “did not give me enough confidence in their overall accuracy to hold the accused accountable for assaults or abuse, or warrant Article 32 proceedings.”


The detainees who were beaten and the one who died were innocent of the crime they were being "interrogated" about and were released later that day.

“What happened in Kalach involved just one death in a conflict that has taken thousands of lives, but it had broader consequences,” the Times reported. “Instead of winning over the local population, the goal of the mission, the reported abuse further alienated villagers. It drove some previously cooperative Afghans to leave for Taliban-controlled areas, residents said.”

What does this have to do with Bergdahl? I don't know, maybe nothing, but it does show that military justice can be arbitrary.
 
Bergdahl's defense attorney leaked info to the NY Times that Bergdahl would stand a summery court . The leaked info had no basis except wishful thinking but it's the radical left's only pitiful hope to vindicate the Hussein's idiotic support of the alleged deserter.
