A 30.06 bullet would have gone right through Kirk's neck like soft butter. It wouldn't have shattered into small fragments. The ATF couldn't conclusively determine that it was or wasn't fired from the gun supposedly used to assassinate Kirk.

I've shot 30.06 rounds through a 4x4 post. Soft neck tissue would not have stopped a piece of metal travelling at 2500 feet per second.
