The lawsuit also alleged, that while most rides similar to the Free Fall are equipped with a harness and seat belt, the Free Fall ride did not have seat belts.

The approximate cost to add $22 seat belts to the ride's 30 seats is $660, the suit said.

There was an manual override that had to been enabled to allow the harness strap to widen to accommodate his size.
That had to be performed by a ride operator. Negligence, plain and simple. Best to see about settling. They ain't gonna win this one.

Perhaps, but since the ride operator is/was an employee of the park, then the park is also liable for allowing a poorly trained or unqualified person operate the ride.
