amusement park sued over childs death on ride

how is this the amusement parks fault? And Crump haunts the scene again. Do not know if the family can win this or not.
Let’s see

They altered the seat to allow a nearly 400 lb patron use the ride
There was no seat belt
No restrictions on how big a rider is allowed to be

We live in a society where it is racism if someone is denied. The father at first spoke that one of the things is that money means nothing. Now it is different. We keep kissing butt, and the payoffs keep going on. This can affect everything. Imagine going on a passenger jet and you do not fit in the belt to your seat as just one example.

Maybe the operator but not the park or the ride manufacturer.
The parents are throwing a wide net going for the deepest pockets

The ride was not safe for their son to ride on

You should not just slip through a safety harness

The lawsuit also alleged, that while most rides similar to the Free Fall are equipped with a harness and seat belt, the Free Fall ride did not have seat belts.

The approximate cost to add $22 seat belts to the ride's 30 seats is $660, the suit said.

The ride operator should never have allowed him on the ride no matter how much he bitched and complained. Not the fault of the Park or the ride manufacturer

Manual adjustments had been made to the sensor for the seat in question that allowed the harness-to-restraint opening to be almost double that of the normal restraint-opening range,” Fried said.

“These mis-adjustments allowed the safety lights to illuminate, improperly satisfying the ride’s electronic safety mechanisms that allowed the ride to operate even though Mr. Sampson was not properly secured in the seat,” she said.

There was an manual override that had to been enabled to allow the harness strap to widen to accommodate his size.
That had to be performed by a ride operator. Negligence, plain and simple. Best to see about settling. They ain't gonna win this one.

The ride operator does not set the rules
Size limits should be posted
They we’re on other rides

Perhaps, but since the ride operator is/was an employee of the park, then the park is also liable for allowing a poorly trained or unqualified person operate the ride.

Show which rule prohibits a 380 lb patron
According to that manual, the maximum weight limit for riders is 287 pounds

The opens the park wide open to be sued for negligence.

This story has endless traction because the teenager was not a white kid from the sticks. The federal government has guidelines on obesity. Being that age and that heavy means, he was not healthy and not athletic.

Amusement parks are supposed to be safe
This one wasn’t
The kid did nothing wrong, he trusted the ride to be safe

The kid was on the Football Team

He didn’t die because he had a heart attack due to obesity. He died because the ride wasn’t safe
