The Eastman memo defined exactly how to pull off the coup is not in dispute.

Why was Eastman trying to hide his documents from the select committee? This was a big loss for Trump//Eastman:

In response, the committee argued — under the legal theory known as the crime-fraud exception — that the privilege does not cover information conveyed from a client to a lawyer if it was part of furthering or concealing a crime.
Mr. Eastman then argued the committee had offered “no evidence” of the existence of a crime-fraud exception, prompting the committee’s latest filing.“The evidence supports an inference that President Trump, plaintiff and several others entered into an email agreement to defraud the United States by interfering with the election certification process, disseminating false information about election fraud, and pressuring state officials to alter state election results and federal officials to assist in that effort,” the filing states.
It also made reference to a recent ruling in a civil suit in Washington, D.C., in which Judge Amit P. Mehta of the Federal District Court found that it was “plausible to believe that the president entered into a conspiracy with the rioters on Jan. 6, 2021.

Luttig played a key role in supporting Pence as the former vice president refused requests from Trump, under the advice of conservative Claremont Institute lawyer John Eastman, to reject the results of the 2020 elections.According to a memo obtained by journalists Bob Woodward and Robert Costa, Eastman reportedly told Trumpthat Pence could simply refuse to certify the electors sent by the states, thus throwing the selection of electoral votes to House of Representative state delegations that were dominated by Republicans who supported Trump.“The fact is that the Constitution assigns this power to the Vice President as the ultimate arbiter. Luttig published a tweet thread the day before the Jan. 6 insurrection on whether Pence as vice president had the ability to change the way Electoral College votes were counted. Luttig concluded that Pence did not.“The only responsibility and power of the Vice President under the Constitution is to faithfully count the electoral college votes as they have been cast,” Luttig wrote.
Luttig said in an interview with Frontline in the days before the Jan. 6 committee hearings began that it was clear “the plan was to overturn the election through the exploitation of what I’ve called the institutions of democracy and the instruments and instrumentalities of our democracy.”
“We know now there’s no question about it,” Luttig said. “They knew exactly what they were doing. And they believed it.”
