If Fox hadn't lied, they would have had an iron clad defense against defamation. But they did lie.

That means malice was Fox's last legal defense. Their lawyers, specializing in defamation looked at their odds of losing on malice

.....and Fox offered the single largest public defamation settlement in history. Ever.
