The Trump foundation was never a charity. It wasn't set up to be a charity. It was an accounting function set up to hold and distribute the funds from the book The Art of the Deal. When the funds were depleted and the foundation to be wound up and closed the AG of New York sued to keep it open and demanded that it be funded as a charitable organization.
