U.S. Citizens Say They Were Detained By Border Patrol Agent For ‘Speaking Spanish’

You cannot just stop people on the street and ask for their papers. They broke no laws.

Really? Show me the law that says a Border Patrol officer can't initiate a conversation and make a polite request for ID (and no, calling a driver's license "your papers" does not make it sound ominous, it just makes you sound like a moron), or that those women didn't have every right to politely decline.

A uniformed officer comes up to you and asks for a ID. You are the one who sounds like a moron and jack booted thug to boot. They broke no law and the officer in question did not say they did not have to give up their ID.

I don't have a guilty conscience, nor am I a trantrum-throwing drama queen, so law enforcement officers hold no fear for me. Neither does conversing with them, or politely asserting my rights (largely because, unlike you, I actually know what they are). They're human beings, not ogres. Get a grip.

Furthermore, OF COURSE he didn't tell them they didn't have to give him their ID. He's not their lawyer; it's not his job to give them legal advice on their rights. If the fucking rights are so g*damn important to them, the way they and you and every other hyperemotional snowflake around here keeps screeching, shouldn't they - and you - at least take the trouble to KNOW them?

Law enforcement pretty much counts on criminals, and people in general, to be stupid. Why are you doing it?

I hold my Constitutional rights as very dear. Violating people's constitutional rights does hold fear to me because I could be the victim. Being stopped and asked for a ID is not a conversation. ICE regularly uses questionable tactics. They were recently told by a federal judge that they were liars because they falsely accused a DACA recipient of being a part of MS-13.

To Deport a Dreamer, ICE Claimed He Was “Gang-Affiliated.” A Federal Judge Ruled That ICE Was Lying.

ICE Agents Manhandle NY Farmer, Break His Phone After Warrantless Arrest

He had no right to ask them for their ID. He had no right to keep them there for 35 minutes after that.

Corrupt cops rely on stupid people like you to look the other way and make excuses. Why are you doing it?

Spare me, Chuckles. You wouldn't know your ACTUAL Constitutional rights if they crawled up your pants leg and bit you on the left ass cheek. What you're "holding as very dear" are your imaginings about your rights, and your inflamed sense of entitlement. You've made this abundantly clear. And it's no wonder you're going through life trembling in fear: if I was trying to sustain a fantasy of the world in contradiction to all the reality around me, I'd probably be afraid of having my bubble burst, too.

Meanwhile, back here on planet Earth, the word "conversation" carries no requirement that you like or enjoy the topic, so yes, an officer requesting your ID does qualify, however much you enjoy a good shiver about "jack-booted thugs" and ludicrously overblown descriptors.

Other than that, I see that you have opted to cravenly chicken out and signal utter surrender by resorting back to "This is reality! I say it is! No proof, it just IS!" instead of manufacturing some maturity and offering fact.

Your acknowledgement of your total defeat in this debate is noted, and you are free to go. Buh-bye, twit. You don't even know what the 4th Amendment is.

I have a better acknowledgement of them than you do. I guess you are one of those people who piously assert Constitutional rights when it affects you but look the other way when it doesn't.

A uniformed officer comes up to you and says he wants to see a ID and that is a conversation to you. You live in a alternate reality that is more akin to Russia where you can be stopped for anything. Where officers are not held accountable for illegal actions. You apparently work overtime making excuses.

Your reality is a fantasy world you live in. A officer stops you and asks for ID. That is not a conversation. That is a detention. The fact is that you are not interested in facts. You have decided you don't believe these Hispanic women should be here so no fact will change your mind.

You don't even know what the 4th Amendment is. :290968001256257790-final:

"If you are approached on the street or in a public place, you do not have to answer agents’ questions or provide identification. Ask if you are free to go. If you are not free to go, you are under arrest and have the right to remain silent."

Notice that even the ACLU does NOT say the Border Patrol "doesn't have the right" to ask you questions or request ID. All they say is that you don't have to answer them, which is exactly what I'VE been saying. If you don't bother to know your rights and allow them to take up your time, that's on YOU, not them.

Effing leftist twats, ranting and raving about "standing up for their rights", and then not even doing it correctly for the actual rights. Morons.

What rights were actually violated? I wasn't aware ANYONE had a right to never be spoken to by law enforcement.

Start with the 4th Amendment. Illegal search and seizure. The agent had no probable cause for detaining them for even 2 minutes.

Start with where having a conversation is not "detaining", and CERTAINLY isn't searching or seizing, and then explain to me what the fuck the 4th Amendment has to do with it, other than your vague notion that anything you don't like MUST be "Unconstitutional".

They did not have a conversation. Illegal search and seizure is exactly what Joe ARPAIO was found guilty of when he stopped people with no probable cause. You are the one who believes that anything you like is constitutional and anything you don't like is unconstitutional.

Actually he was found guilty of contempt of court.

Taxpayers have forked over nearly $56 million since 2007 to pay Maricopa County's costs in the ongoing racial-profiling lawsuit against former Sheriff Joe Arpaio, the latest county totals show.

Seems you understand less about legal issues than you do constitutional issues. Civil costs and judgments aren't convictions.

Libbies dont much like the law. They find it the gravest affront when law enforcement seeks to determine if anything is amiss. They are selfish, putting their own feelings above the facts of society’s general well being

Some people believe in the Constitution. The founding fathers put together the Constitution for a reason. They thought there were certain rights that are unalienable. Apparently you do not believe in that.

Which he is not allowed to do. Speaking Spanish is not a crime. HE had no right to ask for a ID.

Actually he did, they were within a border control zone. Border Patrol can question anyone within them.

It's been upheld by the Supreme Court. Did you not read the town is close to the Canadian border?

Amendment
.

So what. Does that mean NY can suspend the 2nd Amendment. It is close to the border. there was no cause to stop these women.

Funny how stupid people make stupid statements even after being presented the facts. Get back to me after you finished your border patrol training.

.

You seem to believe in Constitution free zones. I don't need to learn how to be a jack booted thug.

Do you fly? Airports are truly Constitution free zones. But that's different, right?

.

Is that the best you can do?

Mods, please sticky this thread, for I would love to see the same assholes that are defending jackbooted thugs detaining citizens for no reason other than speaking spanish, suddenly care about freedom and liberty when someone's 2nd amendment rights are violated by a Terry stop...I bet these same hypocritical bigots also backed Cliven Bundy's "little alamo" standoff.

It’s truly astonishing we have to have this conversation

Next time speak English. See if that resolves the problem...

Or be held by authorities, even after producing their "papers"?

What if I don't want to?

What if I don't speak English?

Why are you RWNJs so damn eager to throw away basic American rights?

Over the years, the Supreme Court has upheld Border Patrol agents' authority to stop and search people in the border zone, while also defining some limit to their powers. For example, the Court has ruled that agents must have probable cause to believe that someone committed an immigration violation to search their car in a border zone, but they only need a reasonable suspicion (a lower standard of proof) to stop and question them. If they establish a roadside checkpoint within the border zone, they can stop and question anyone who drives through about their immigration status.

Stopping Americans for speaking Spanish: the latest evidence that Border Patrol agents have too much power

Speaking another language is not reasonable suspicion.

Cite the law supporting you.

Explain the 35 minute detention....all based on speaking Spanish.....It's so funny to watch trumpanzees willing to go to the wall for their precious guns, but give up their other freedoms so willingly.
Detention for 35 seconds was unwarranted.
No, 35 seconds isnt enough time to determine if they are legal residents. I think anything up to a fews hours is appropriate.

You cannot just stop people on the street and ask for their papers. They broke no laws.

Tell me:

What law did a guy break when his rare gun collection gets confiscated just because someone decides it is too big and they don't see what need he has for it?
What law does a person break when a community decides he must take down his nativity scene @ Christmas because it was too religious?
What law does a business break when a customer want them to provide a service they don't offer because it offends them, so the Fed sues them?
What law does a president break when a political party decides to pitch a tent up his ass for a few years because they didn't like that he beat their opponent?
What law did a panicked dental assistant break when she gets gunned down in her car for making an illegal U-turn in Washington DC?
What law did a border agent break when he merely stops a couple people speaking a foreign language at the border in an area where no one normally speaks foreign languages, just to check them out enough to make sure they aren't any person of interest?

Try the 4th Amendment for starters. Speaking a foreign language is not a crime. You cannot stop someone without probable cause.

My Only Real ObjectioN is this. :1peleas:

Still waiting for you to cite any laws supporting your claims, and very, very aware that you're probably dodging like a chickenshit.

You clearly do not understand the Constitution. What laws were they violating. Speaking Spanish is not illegal. The 4th Amendment clearly applies here. You sound like the chickenshit here.

You ARE the absolute PINHEAD here. Were they CHARGED WITH A FREEKING CRIME? No? Then what is your f----ing point that Spanish isn't illegal? Trying to reason with people like you is like asking a dog why he doesn't want to go outside----- I could stack books citing case law all day long why your arguments don't hold a drop of water, but I might as well be talking to a chimp. If speaking Spanish was illegal, he would have arrested them for it. His concern was simply that they weren't legal citizens.

You cannot just stop people on the street and ask for their papers. That is why Maricopa County was forced to pay big bucks for what Arpaio was doing.

Really, jackass? So the next time a cop pulls you over and he asks for your driver's license for whatever reasons, you're going to go tell him to go get stuffed. Go for it.

Law enforcement shouldn't bother us if we conceal carry but should be able to violate our privacy if we are speaking Spanish.

Unfuckingbelievable.

And BTW the states RETAINED the authority to regulate immigration / Fedgov has USURPED the authority

Hey dog-turd-breath,
Who ever said LEOs shouldn't "bother us" if we conceal carry? First of all, how's he gonna know I'm carrying if I'm concealed? Second, if I flash my gun for no good reason, I've broken the law. Third, if I prove to have a concealed weapon, in 99% of the situations, I better have a CCW to go with it. Forth, it isn't a "violation of my privacy" to be stopped by the Border Patrol AT THE BORDER if he thinks there's something he wants to check. That's HIS FRICKING JOB, IDIOT, to protect the public safety, God Bless Him, and English, Spanish, or Swahili, if an LEO stops me with a question and a need, it is my duty and pleasure to cooperate with his request any way I can and I'm glad to help him out in any way to make his job easier, and if those people got detained for 35 minutes, then BIG FRICKING DEAL---- I'll bet you good money they did something to jack the officer off just as I know you'd do and I only wish I was a Border Agent and I had you to stop, you're such a hard commie dick I can tell, I'm sure you'd give me cause to hold you over for a couple hours, maybe run a dog sniff of your car. I'm sure I'd find something to bust your ass on, probably drugs in the glove box (you're a pot smoker I bet) or suspicion of being a low life.
