The indictment acknowledges he can verbally say it is stolen all day long forever but his actions must be within the law. Initially they were all within the law and he lost. Then he attempted actions that are illegal. If he felt his actions were legal and they are illegal he is guilty. Actions not speech. Trying to stop the Pence from approving the election is illegal.Sure but that's not the issue. In this case, the entire case rests on whether or not he actually believed the election was NOT stolen and acted in contravention of that belief.
