Before you try to tell us that P01135809 was "Not An Officer", let me remind you that as president he also held the title of "Chief Executive" and was therefore an officer of the United States.

Is not the same as "have been convicted of"

And the 14th does not include any judicial remedies, only a 2/3 vote by congress to remove the ban.

Given that the 14th does not give the Courts jurisdiction but does give it to the legislature(s) my view is that only the legislatures at the State and Federal levels can make the determination.

If the 14th Amendment is so clear that conviction is not required. How come court after court in state after state has thrown that argument out and ordered Trump back on the ballot?
 
The 14th doesn't require any conviction but the hundreds of currently convicted including those who've said they acted on Trump's orders are enough to make the presumption.

This thread is more about the process than the individuals.
The 14th amendment was created to be used by the Congress to control the states. States have no juridiction on the 14th amendment.

The states therefore can decide if a candidate has commited or supported insurrection
That decision, once made by any state can only be reversed by a 2/3 vote of the Congress
