California is a "may issue" state. "May-issue" laws are constitutional, according to the Supreme Court. Thus, the Sheriff is conducting legal behavior.

Kim Davis does not have a legal right to refuse to issue marriage licenses. Kentucky does not have a "may issue" statute for marriage licenses.
 
If Kim Davis was a gay activist who refused to issue hetero marriage licenses, she would be feted as the ACLU's Martyr of the Year.

Nope both are constitutional issues. Kim's 1st amendment rights are being violated and those 7k people's 2nd amendment rights are being violated AFTER a court ordered the licenses issued.
