Actually both were committing crimes. Rittenhouse was guilty of purchasing a weapon in violation of the law. Possession of a weapon in violation of the law. That is why his self defense argument is not gaining any traction. It can not be claimed as a valid defense if you are committing other crimes at the time of the event. It is why the Robber can’t claim self defense when he shoots the clerk.
what is funny is how the same we have to punish criminals cheerleaders are now saying that Rittenhouse’s crimes were not really crimes because. Well. UM. He was doing something good.
Well there is some truth to that. We excuse crimes when a higher food is being served. Breaking a window and getting something out of a car is OK on a hot summers day and an animal or human life is in jeopardy. We don’t charge people with destruction of private property or auto burglary or kidnapping.
That sort of presupposes that the baby or animal is not taken from the area. You know across state lines and that sort of thing.
So Rittenhouse was a criminal before the first shot was fired. He could have been arrested before he arrived at the scene. So self defense isn’t going to fly any better than a brick.
