If a policeman involved with a criminal case has a good working relationship with a prosecutor, does the prosecutor have to recuse? No, never. It's not a conflict of interest for people on the same side of a case to have a relationship.

Same situation here. Comey is a witness against Trump, not a person being investigated. He's on the same side as the "prosecution", so there's no conflict of interest.

Now, Rosenstein is a Trump-appointee, a man with a relationship with Trump, and potentially a witness against Trump. He has a conflict of interest, so he should recuse.

I dont think the scope of the investigation is that narrow, regarding only the Trump campaign interface with Russia, as some Democrats are being called to testify along with Trumps people, and Comey is definitely a person of interest seeing how he has been engaged in leaks and was part of the trump administration as well.

he's not and was not engaged in leaks, his own contemporaneous notes of an unclassified meeting, released after he was let go, was his prerogative, and perfectly legal.

this investigation IS NOT an investigation of Comey. Comey was not part of the Trump campaign, Comey did not meet with the Russians....???

IF Trump was going to be charged with obstruction of an official investigation.. for impeachment, then on that part, Comey could be a witness, but Comey is no longer FBI Director so he has no conflict, and if Mueller believes he has a conflict due to working with Comey in a previous job, then he will recuse himself, on THAT PART ONLY.
