New York Changes Law So It Can Still Prosecute Those With Presidential Pardons

Doesn't matter, Dem's have no respect for the law. The ignore the law whenever they feel like it.

Really? Is that why Trump and his mafia keep breaking laws? Are they actually Democrats?

Liar. Name the laws Trump broke. :itsok:

Speaker Pelosi will soon spell them all out for you. That doesn't count the ones already convicted and/or in prison.

“Speaker Pelosi” sounds much like “Comrade Stalin” doesn’t it? Or “Chairman Mao”?

No one is above the law and New York will not turn a blind eye to criminality,” Gov. Andrew Cuomo said.

New York Gov. Andrew Cuomo (D) signed a new law on Wednesday that gives the state the authority to prosecute those accused of crimes even if they have a presidential pardon.

The bill effectively closes a double jeopardy loophole that usually prevents individuals charged on the federal level from being prosecuted by a state for the same offense. The measure was written to specifically target former Trump administration officials who may receive a pardon, an idea the president has regularly suggested for aides who have run afoul of the law.

“No one is above the law and New York will not turn a blind eye to criminality, no matter who seeks to protect them,” Cuomo said in a statement Wednesday. “The closure of this egregious loophole gives prosecutors the ability to stand up against any abuse of power, and helps ensure that no politically motivated, self-serving action is sanctioned under law.

The law goes into effect immediately and applies to all past and future offenses. New York officials will be able to prosecute any pardoned individual who served in the executive branch, worked for a president’s election or transition team or for a for-profit or nonprofit group controlled by a president.

Great news! Thank you Governor Cuomo!

And nobody sees the problem with people who change the law to “target” certain political groups?

The only thing I see wrong with it is it took too long before it happened.

Sounds exactly like what Comrade Stalin and Chairman Mao did now that you mention it.

Nope. That's the succession to the presidency that the founding fathers laid out for us. Can you say Madam President?

supporter of the Founders now are you? The Founders would be appalled

And you already have Pence up on charges? Your old bag will never be President. She would like to overthrow the elected President and then become an unelected President. But there aren’t enough beta males or illegals in the country just yet.

But keep visualizing. After every defeat.

Does the President have authority to grant clemency for a state conviction?
No. The President’s clemency power is conferred by Article II, Section 2, Clause 1 of the Constitution of the United States, which provides: “The President . . . shall have Power to grant Reprieves and Pardons for Offenses against the United States, except in Cases of Impeachment.” Thus, the President’s authority to grant clemency is limited to federal offenses and offenses prosecuted by the United States Attorney for the District of Columbia in the name of the United States in the D.C. Superior Court. An offense that violates a state law is not an offense against the United States. A person who wishes to seek a pardon or a commutation of sentence for a state offense should contact the authorities of the state in which the conviction occurred. Such state authorities are typically the Governor or a state board of pardons and/or paroles, if the state government has created such a board.

It is never good policy to write a law to target a specific group of people, even if you do not like their politics.

Petulant children ... still sore about losing the election.

Trump should not pardon Hillary or Obammy, they should rot in Gitmo

From the OP:

The Associated Press reported that 24 states currently have laws to clarify that presidential pardons do not apply to state charges.

You do realize, don't you, that if the president can only pardon federal crimes, a law a state passes allowing them to prosecute pardoned crimes puts that state in the position of prosecuting FEDERAL crimes, right?

That won't stand because it voids presidential pardon power. Anyone pardoned by the president would simply be prosecuted by a state instead.

The only way that happens is if they both went at the same time. It wouldn't, and the first thing Pence would do is appoint his own VP.

It is possible to be charged for the same crime at both the state and Federal level and be tried at both levels independently of each other.

Thus charging someone at the state level for a crime they were pardoned for at the national level would be perfectly legal and does not violate double jeopardy laws
