NEVER, talk to the police.

If you go into a interview room and remain completely 100% silent, what can they do to you?

They know exactly where to hit ya so it won't leave a mark. At least they did when I had a little weekend stay for DWI. But that was 25 years ago.

Whether you are guilty or not does not matter. When questioned by police you should always invoke your rights under Miranda. Always.

They are not looking to be your pal, they are not looking to do anything other than, get YOU to do their job for them by incriminating yourself.

This isn't a knock on the profession, it's just reality. Interrogations are for one reason only: For you to give them something they don't have. Otherwise, they wouldn't even bother with it and just book you.

They fish. It's their job.

I was pulled over whilst driving, and the cop said "Do you know why I stopped you?"

I said "I will not answer without a lawyer."

It all went downhill from there.

Sometimes it's worse if ya talk.

You failed the attitude test. There are some times you can get pulled over and cop a tude, and sometimes not. Whenever it's a nonmoving violation then by all means mouth off and pay the stupid ticket if it makes you feel better: burned out headlight, lamps, expired tag etc. but if your're speeding or god forbid drunk then it's probably prudent to have a better attitude. If you have contraband in your vehicle by all means don't be stupid, but play cool. And if your high or intoxicated keep your mouth shut and your eyes straight ahead. Now, .08 is not exactly impariment to some people but it's legal enough to really mess you up in a big way. The more you talk, the more the cop smells. If the cop looks at your eyes and they're watered up and your pupils won't dialate then he has probably cause to take his search further and if you're facing a DUI 1 then I'd say in most cases your better off shutting up and refusing the test. They're going to arrest you and take your license anyway but why allow them to gather anymore evidence to convict you? Even if you pass their tests you're still probably going to jail for the night. In any event it's always better to be polite and not make them nervous but don't believe that honesty will get you out of jail because it won't. They cop could care less. He's just laughing at your stupid arse for giving away more evidence. Don't buy the good cop routine.

Keep you for awhile then let you go. Depends on the circumstances. Did they actually make an arrest or are you just being detained? These are important things to consider.

It should be "once in custody". If you are pulled over..be polite. Always.

I'm always polite. Well mostly always polite.

The weekend I spent in jail was very enlightening. First off..the guards are completely corrupt. They were taking bribes for decent sandwiches and phone calls. Some of them knew the guys in the lock up..it was pretty amazing. The guards were making really good money too.

I consider it a badge of honor to have been arrested once. Was only a few hours and it was nolle prossed by the prosecuter so no biggy. You can learn a lot by your experience, even the negative one.

That's basicly what the cop said. And they call them interviews, not interrogations. lol

And They can legally lie to you and misinform you.

I cannot stress this enough. While you can't legally lie to a cop, they can lie to you. Be very careful when it comes to them trying gain access to your vehicle. There are tricks. Never allow them to search your car, ever, even if they threaten you with the stupid drug dog. It's a feingned attempt to intimidate you.

The cop stated that "if I want to stop you, all I have to do is follow you. If I follow you long enough you're going to get nervous and make a mistake. Then I have a legal reason to stop you".

Reflect on it as a moment of clairity when your predisposed opinions about the system came crashing down.

Only experience can get you passed this. They call this "blue light fright". The cop will put his pig head on your bumper in an attempt scare you into a mistake. Eventually, especially if your're impaired, you will use your side mirror in an effort to id who is behind you. In the process you might hit the white line and then he has you. To get to this point, you were probably profiled for some reason. Maybe it was the look on your face, your car, the time of day, who knows. The point is he really wants to look in your vehicle and he can't do that without pulling you over constitutionally.

I'm good friends with a C.O. Let's just say I'm completely amazed at the corruption, so much that I automatically sympathize with the alleged drug dealer who hasn't been convicted but has been arrested and I know he's guilty of it because I saw him dealing drugs.

The bureaucracy is all sorts of fucked up.

And that is 100% true. I got pulled over for using my turn signal too late and then got my car ripped apart because it "fit the description" of a car used in a local drug buy. Long story short, they didn't find shit and the actual car used in the deal was found at the same time by another crew. My stereo system got completely trashed and my glove box never stayed closed after that so I filed for compensation - mainly because I was detained for 6 hours. Never arrested, but told that I could either wait at the scene or get taken to the jail. I got denied because it was a "legal" stop. I inquired about the legality of it and was told I broke the law because I turned on the signal too early. Thousands of dollars and a forensic analysis of the tape later, I was wrong. I signaled 5 feet too late.

During this process, I was told by friends that I should just drop it. When that didn't work I noticed I always had a Police Escort whenever I left my neighborhood. The joke was on them though, I felt safe knowing that I could always be harassed at a moment's notice driving to the office and these days I miss not having the backup when I've got my kids in the car and I drive through a very bad section of town.

But yeah, I got a few tickets during that time. Did you know that driving too slow is creating an unsafe traffic condition and that's also against the law? We're not talking 40 in a 65, we're talking 25 in a 45 with a cop on your bumper and a red light 350 feet in front of you.

That's the part that irks me, the fact that the Police can break traffic laws to create a situation where any reasonable person would break the law - like tailgating and swerving. It's the word of some schlub against a decorated Police Officer. How can I prove I broke the double yellow lines to avoid the cop car speeding by me, not even knowing the guy tailgating me in an unmarked car was also a cop when they both testify that they were both far behind me?

Oh and video evidence? Well let's just say that if the movie Avatar was admitted as evidence a jury would believe that the video is real and accurate if the person presenting the evidence is credible. Good people do bad things sometimes, but the justice system is built on assumption of innocence and the good intentions of those putting their lives at risk to stop crime. In a country of 300,000,000 people there is plenty of room for people to fall through the cracks.

Umm, you're all starting to sound sort of like the Jared Loughners of the world. His rantings about the police would fit right in with this thread.

I was on a jury one time for a criminal trial (DUI), a call was made 2 blocks away, different brand vehicle-and color. The man in the car was sleeping, the car was turned off and parked (legally) in a parking lot. The man claimed he was a diabetic, and needed to rest before going home. The cop in the video would frequently turn the audio on and off, and when another cop approached the scene (who refused to testify against the suspect), the main cop told him to mute his mic when when he told him to, to talk undetected-and they actually did this.

The state of Florida tried the guy with DUI, even though he had an alibi (he was at work like a half hour before that, and didn't drink there), did have diabetes (medical records proved), and as I said one cop at the scene refused to testify (at the trial it came out he was asked to).

Long story short-after a 2 day trial it was obvious the state of Florida was covering their own officer's ass against this man who did nothing wrong. It took us about 5 mins to reach our not-guilty verdict. It was an eye-opening experience to say the least.

edit: forgot to mention the guy passed all the tests the cop gave him to determine sobriety-and did so on video (which we saw).

Yup. That's where the accusations have some serious bite - the pro-big government types have created the narrative where anyone who mistrusts the government is a wackjob that's going to kill a Judge and accidentally hit a Member of Congress.

Actually, you said that, I did not.
