One of the arguments is who gets to determine if he engaged or not, in an insurrection for disqualification, and the uniformity of the who and how, for all the states....was what I got out of it....

The funny thing is how MAGA only looks at “winning”, even when it isn’t, instead of what is good for the country. They are perfectly happy to support an insurrection but unwilling to accept the consequences of their behavior.

There is no question in my mind that Trump was involved in an insurrection, but what they are basing this on was a civil war era law that clearly applied to the Confederate leadership. To use it now would risk creating a broad and vague definition of “insurrection” and setting a very dangerous precedent where partisan legislatures, election officials or elected officers could use it to strike anyone off the ballot for flimsy reasons.

I think in this case…removing someone from the ballot for this reason sets a dangerous precedent - the cure is worse than the illness.

I listened to most of the arguments this morning and I concur that the justices, even the most liberal ones, were not fond of the idea of a state dictating who could and could not be on a federal ballot. It is a no brainer that if they rule for Colorado, the weaponization of government will extend more deeply into the states and every viable candidate will be subject to that kind of persecution.

Just as if the government is successful in taking Trump out with these insane investigations/prosecutions, no opponent of the sitting government can expect to not be similarly investigated/prosecuted and eventually the whole system could collapse.

What insurrection? Trump got the proper permits for the rally and the intention was NEVER to overthrow or interrupt any process of government but to let the people's desire be known to delay certification of the election until the preliminary investigations could be complete. Tens of thousands of people there believed with all their hearts--most still do--that the election was corrupt and that Trump won. So did many millions of others who were not in DC that day.

Trump did not ask for, have in part in, or encourage a violent riot, breaking or entering. The verdict is still out on who did instigate that and more than a few believe Pelosi, the FBI et al were complicit. I won't say that myself without hard evidence, but I sure won't rule it out either given her taking the opportunity to use the occasion for a photo op for herself and her daughter with a video camera there to oblige her.

And it is 100% obvious that overthrow of the government was not the intent of the relative few who participated in the riot. Once inside they became calm and the Capitol Police were not at all alarmed at their presence and even accompanied/escorted them on a tour of the building. And all left the premises without further incident.

There was no insurrection. And I have to believe that only the most clueless and/or politically motivated continue to call it that. So far not a single person arrested and/or sentenced due to the events of Jan 6 has been charged with or convicted for participating in an insurrection.
