Marriage "Equality" and Other Nostrums

    Q. What is the government's legitimate interest in marriage?

    A. The protection and welfare of children.

    Q. What is civil mariage?

    A. A legally created contractual relationship which grants specified rights and imposes specified obligations on the parties.

    Q. Does a State have the right to specify eligibility requirements for these contracts?

    A. Of course it does, just like other provisions of contract law.

    Q. Why not same sex marriage?

    A. Two issues: 1) Portability and 2) Furtherance of legitimate interest (children).

    Q. What is a solution to the destruction of the American family?

    A. Restrict No Fault Divorce to couples without minor children and provide significant tax advantages (e.g., joint returns) only to married couples with minor children.
