Man gets 13 years for shaking baby

ST. CHARLES TWP. — An Aurora man has been sentenced to prison after pleading guilty to shaking a 3-month-old child.

Juan Martinez, 30, 800 block of North Gladstone Avenue, agreed to a 13-year sentence in exchange for pleading guilty to aggravated battery to a child, the Kane County state’s attorney’s office said.

According to prosecutors, sometime between Jan. 1 and Feb. 10, 2010, Martinez held the baby by the head and shook it. The child suffered head trauma as a result.

When questioned about the incident, Martinez told police he was frustrated that the baby would not stop crying, prosecutors said. The child appears to have recovered fully from the trauma, prosecutors said.
