LA County District Attorney George Gascon's 1st day in office: ends death penalty, cash bail, trying children as adults, criminalizing mental health

Interesting, so if someone walks outside of their house without a mask on, they wont be arrested? Or if they are arrested, then they are released? Seems that Los Shitalot, has some very confusing rules.....

He can't actually end any of these things. All he can do as a prosecutor is not ask for them. The judge can impose anything.

Actually he can. Take the Death Penalty. The Prosecutor announces that he is seeking it during the preliminary stage. This places requirements on the court for the experience and qualifications of the Defense Team. If not announced the Jury or Judge may not sentence the Defendant to Death.

Oh. This probably saved the taxpayers several million dollars every year by the way.

By not filing the Special Circumstances charges. The Judge can not give harsher sentences based upon them. The maximum as well as minimum is set is the law. So even if the Judge was to throw the book. It could not exceed the maximum by law.

Bail? The “people” ask for either continued detention or a high bail. If instead the prosecutor does not oppose the request for release, then the judge has to justify why Bail is set or why pretrial release was denied.

So the Prosecutor can do pretty much all of that. And more.

Judges can always justify their rulings. The people of the state of California approved the death penalty. It isn't likely that a county district attorney can overrule that. Gascon's election will make life in Los Angeles as miserable as he made life in San Francisco.

Actually it does not work like that. At all. Not even close.

The Prosecutor files the charges and specifics. If the prosecution does not list special circumstances qualifying for the death penalty. The judge can not slap it on later. If the Judge did, it would be overturned in about three minutes on appeal.

The Prosecutor asks the court for permission to try a juvenile as an adult. The court decides yes or no. If the prosecutor does not ask, the Judge can’t order.

Judges decide questions. They do not rule by wants and desires. They are not possessed of unlimited power or authority.

Prosecutorial Discretion is used to justify not charging cops when they violate the law. Or when they are caught lying on the stand. This is no problem whatsoever for the RW. But if a Prosecutor says he is going to use that same discretion on anyone else. Oh he can’t do that.

Well. He can. And not just in California.https://www.texastribune.org/2019/05/21/dallas-district-attorney-john-cruezot-not-prosecuting-minor-crimes/

A lot of Prosecutors are seeing the light. The returns are just not worth the expense. Or the effort.

But hey. Blame California. Blame Liberals. Blame everyone but yourself. Because you want everyone locked up. And don’t want to pay for it. Because it cost a lot of money to do. Prisons cost money. Lawyers. Courts. Trials cost a lot of money. Death Penalty Cases cost the Taxpayers upwards of ten million dollars. Often far more. But pretend the only argument is that Liberals love criminals. It keeps your view shallow and keeps you from looking in the mirror.

The major exoense of a death penalty is appeals. If the bailiff shot the guy right after the verdict was read it would be much cheaper. Liberals don't love criminals as much as they hate law abiding citizens.

Ending cash bail was on the ballot. It failed. Yet this little Castroite discards the will of the people in favor of liberal tyranny.

He's not a federal prosecutor,. Just a county DA. He doesn't have any power past the county line.

You're right. Should have paid more attention. I thought he was another moonbat Sleepy Joe pick.

We need a star chamber. A group of dedicated enforcers that will administer justice when the state has failed.

The initial expense is the trial. The Attorney representing the Accused has to be good. He has to have experience in capital murder cases previously. So this experienced lawyer is consequently more expensive. A price paid by the State to insure a fair trial. So the costs of the trial tripled right off the bat. But wait. We go on.

California has a law which requires an automatic appeal to the State Supreme Court when Death is the sentence. Guess you hate that law too.

But wait. Death Penalty Convicts get three appeals paid for by the taxpayers. That is the Federal Appeals. Damn that Supreme Court insisting that we make every effort to insure only the guilty are put to death.

So major costs for lawyers. What about housing? That cost five times what the average prisoner costs to house.

in other words. You can sentence five people to twenty years for the cost of housing one Death Row Inmate.

But you want the bailiff to execute him then and there. Fine. Tell you what. I will agree to that with one condition. Just one condition.

We can call it the Bet your Life law. If the person executed is proven innocent later. Everyone involved. Cops. Jury. Prosecutor, the Bailiff, and the Judge are executed within thirty days for murdering an innocent. The cops who testified. Everyone is put to death as punishment for their crime.

So are we in agreement? Instant carrying out of the sentence. And if the guy didn’t do it. Everyone involved dies. Sounds fair doesn’t it?
