WASHINGTON (Reuters) - The summons sent to Donald Trump as part of his indictment for illegally retaining classified documents indicates U.S. District Judge Aileen Cannon, who was appointed by the former president, will be assigned to oversee his case, at least initially, ABC reported on Friday, citing sources.
Reuters was not immediately able to confirm the ABC report. Often, the judge who makes an initial appearance in a case does not proceed to oversee it.

The appointment, which may only be preliminary and a function of the fact that she previously ruled on a search warrant that was part of the same case, triggered an immediate reaction from legal experts.

Former federal prosecutor Joyce Vance argued on Twitter that if Cannon ultimately ends up fully assigned to the case, special counsel Jack Smith, who is overseeing the prosecution, would have grounds to ask the 11th Circuit to force her to step aside.

"Before everyone gets too spun up about reports Judge Cannon has been assigned to the Trump case, a little law. I used to be an appellate chief in the 11th Circuit (where Florida is) and I litigated a few appeals where we asked the court of appeals to order a judge to recuse," wrote Vance.

Although a judge's behavior in court generally doesn't form the basis for recusal, the 11th Circuit has ordered 'reassignment' where a judge leans so heavily for a defendant they call their objectivity in the eyes of the public into question ... This is persuasive authority that Judge Cannon must step aside if the case falls to her as a permanent assignment. Her court and certainly the 11th won't tolerate the damage it would do to their credibility if she failed to voluntarily recuse."

But assuming that Cannon does end up trying the case, other experts weighed in on some of the implications.

Cannon will have a large amount of say in how the trial goes, from considering motions to dismiss, to deciding what can be submitted as evidence, to conveying instructions to the jury. Trump would likely want to go even further and request a bench trial, cutting out the jury entirely and simply allowing Cannon to determine the verdict herself. But not so fast, wrote former federal prosecutor Renato Mariotti — that will almost certainly not happen.

Man you guys are transparent....You don't want Cannon to hear the trial because she's a Trump appointee, but do want a liberal Judge to hear it....SURPRISE......Even you know that the Judicial system is corrupted....

Because the 11th circuit eviscerated her defense of Trump, point by point and threw her off the case last year.

Because the 11 circuit slammed her for trying to rewrite the rules, offer Trump special protections, radically reorder caselaw, a violate the bedrock separation of powers.

All to protect Trump.

That being said, anyone willing to do that in defense of Trump....is unlikely to recuse themselves.
 
Democrats will be unhappy with any judge not of the family macropodae.

I think democrats would be happy with any judge that the appellant courts hadn't slapped down for trying to rewrite the rules, offer Trump special protections, radically reorder caselaw, a violate the bedrock separation of powers.

All in defense of Trump.

A lot of Trump appointed judges dismissed Trump's lawsuits. Therefore, it does not mean that if it is a Trump appointed judge that they will try to help him.

I would wait until Tuesday to see what is going to transpire when the case comes to her.

Its not a Trump appointed judge. It THIS Trump appointed Judge....who so egregiously violated bedrock separations of powers to benefit Trump that she was thrown off the case by the appellant court.
 
She will be replaced within a month.

She is doing the opening scut work.

Her worth will be determined when the DA asks for a massive bail.
