The IRS doesn't have the legal delegated authority to impose penalties or levies or seizures for nonpayment of subtitle a personal income taxes. It doesn't have the legal authority to assess anyone with an income tax liability. It doesn't have the legal authority to assess penalties on tax crimes.

Generally, no tax assessment can be made unless a tax return has been voluntarily filed. The problem is, if you don't voluntarily file your taxes you will get into trouble. Something cannot be voluntary and compulsory at the same time. But then again, there are many things which the Government does not have the power to do, and does anyway.
