Not really...if they weren't going to file they wouldn't bother to get an ITIN in most cases. You can't use it for anything else...like collecting ss or medicare or even eeic.

Basically by filling out this form and providing their passport or other form of identification. There is nothing on this that implies one must be in the country legally.

I don't know what the legal definition is...but wouldn't they be asking for proof of status if it mattered? I don't see where they are.

I would rather them have a number and pay into it through proper channels than have them steal my SSN again. It wasn't really fun contacting SS office, IRS, and reporting my identity stolen.
