“The noncitizen possession statute, 18 U.S.C. § 922(g)(5), violates the Second Amendment as applied to Carbajal-Flores,” Judge Coleman, appointed under President Barack Obama, wrote in her 8-page ruling.

“Thus, the court grants Carbajal-Flores’ motion to dismiss.”

“Supreme Court has said the ‘people’ are members of the political community,” Larry Keane, a lawyer for the National Shooting Sports Foundation, wrote on X.

“Illegal aliens in US are not part of the political community and thus do not have 2A rights.”

We don't agree often, but I agree with you on this one. :cool:
I have to disagree with both of you. Unless they're convicted felons, they deserve the right to defend themselves with firearms. This goes to..some amendment..it's late, but whatever amendment offers them protection under the law and basic human rights.

Gotta disagree. Our constitution was meant for citizens, not foreign invaders. And "felon" or not, if they served their time, and were turned out into the public, they should be welcomed back into the fold, all rights, and privileges restored.

People here illegally are not allowed to own a gun because they are actively breaking the law, not because they are from a different country. Legal aliens are allowed to own guns. Saying you can't restrict ownership base on "alienage" (the state of being an alien) is like saying you can't base it on criminal status. By this logic, all criminal background checks for owning a gun are unconstitutional.

A lot of these problems go away if we rule that only citizens and legal aliens have constitutional protection.

Your are correct, that is the 14th amendment.

nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

The Constitution was written for "persons", not citizens.

Why yes, yes they can. More specifically, non-citizens are not prevented from voting in state and local elections by any federal law or regulation. They have the right to vote in state and local elections in California, Maryland, Vermont, and the District of Columbia.

At the Federal level non-citizens are prevented by voting by the Illegal Immigration Reform and Immigrant Responsibility Act of 1996. However, if both the parents of the non-citizen were or are citizens, rather natural or adoptive, the non-citizen can legally vote in a federal election. If the non-citizen permanently resided in the US prior to their 16th birthday, and reasonably believed they were a citizen, they can vote and it is counted.
