If Booth had lived, would he have been acquitted in the death of Lincoln?

Lee surrendered a week before lincoln's death but that did not end the war as Lee's troops were just part of the confederate army. The war ended about a month after the assassination so at the time he was shot, lincoln was still the commander in chief, and thus a soldier, of a nation at war and thereby fair game for anyone from the other side.

Witnesses are not the issue. Everyone agrees booth killed L. But was it justified as part of war.?

CIC is not a soldier? Tell that to a jury.

but lincoln was assuredly a war criminal for allowing and encouraging sherman, sheridan, et al, free reign to murder, rape and rob civilians, burn down their homes and businesses, steal their property and wreck their infrastructure.
Then he sent in occupying forces and provisional military "governors" to make sure the south continued to be punished and have no voice in political matters...

That's not what this thread is about but no question you are right about L being a war criminal. How did he get away with it? He shut down 300 newspapers that criticized the war and threw into prison 15,000 Union citizens that opposed the war. He even had congressman clement valandigham DEPORTED for opposing the war. Along with war criminal, L was a dictator and booth was right to call him a tyrant right after he shot him.

That's not what this thread is about but no question you are right about L being a war criminal. How did he get away with it? Maybe but then again, Lincoln never conceded the confederacy was a separate country. He always said the southerners were in rebellion but still americans. Booth didn't think that but lincoln did.

So what? Lincoln was dead. As the actual history shows, the people looking for Booth didn't much care if they brought him back dead.

They wanted him dead. They knew booth had a fair chance of beating the charge for the reason i gave. They also suspected there were Union officials involved in the assassination and dead men tell no tales.

How could he have beaten the charge? They executed people who were part of the plot, why not the actual shooter? I don't think your reasoning makes much sense.
