Something tells me such a sympathetic piece wouldn't have been written about a white person who uttered racist things while attacking blacks if that white person had been victimized by blacks in the past.

Maybe the judge and the author were thinking the accused couldn't be racist becaues only whites can be racist? That is standard liberal thought on the issue of racism.
