While not the perfect solution, Gitmo was created and has functioned for quite a while now. A better solution has not presented itself.

Post 9-11, George Bush was given a free hand to do anything he deemed necessary to engage in the War on terrorism. Any politician who objected was immediately chastised as unpatriotic. Most politicians are weak and very few were willing to stand up and do what was right.
Most of the world agreed with the invasion of Afghanistan and most still do. Once Bush got power hungry and decided to invade Iraq, it was time for both the Congress and the press to stand up for what was right. Neither had the balls
