Florida lawyer files federal lawsuit to disqualify Trump from 2024 presidential race

Unfortunately..and it pains me to say this, but despite the fact that he's an in the pocket shill, Professor Doucheowitz is correct.
Nothing, not even a conviction for any of the 91 indictments against him will prevent him from running for President.

And if people would just think for a moment with a clear head, having Trump run is a good thing. It ensures the destruction of the Republican party and the fact that none of his primary competitors will make it past Super Tuesday next year.
It will also make his defeat in the general election that much sweeter. :)

I'm an American first. That's why I want to see Trump go the way of the dinosaur.
I've never been a Democrat. Registered as Independent since 2000. Republican before that.

I remember in 2000 Democrat election deniers tried to overturn the election results in Florida in order to make Al Gore president. They claimed everything from confusing ballots to hanging chads. And yet not one Democrat election denier was ever charged or had their mug shot taken.
They went through the legal procedures and when there were no more after the Supreme Court decision they condeded.

No threats, no denial, no incitement to violence, no invitation to come to DC on the day of the certification in order to stop the counting of the electoral votes.

if joe biden is the best your party has your party aint far behind....

That’s it’s unfortunate Congress never passed legislation codifying a mechanism by which a treasonous insurrectionist like Trump would be rendered disqualified from running in every state.
That pesky Constitution, always getting in the way of the Left, innit?

Trump gets brutal news as a Florida lawyer files a federal lawsuit to disqualify Trump from the 2024 presidential race due to the “disqualification clause” in the Constitution's 14th Amendment than bans “insurrectionists” from office.

But it gets WORSE for Trump…

The lawyer declared in his lawsuit that it is “crystal clear” that Trump’s actions leading up to, on, and after January 6 show that he “both engaged in an insurrection and also gave aid and comfort to other individuals who were engaging in such actions, within the clear meaning of those terms as defined in Section Three of the 14th Amendment.”

The lawyer also argues that “the 800-plus page report issued last year by the congressional committee that investigated Trump's role in alleged efforts to thwart the electoral process, as well as accusations he incited the violence on Capitol Hill that day, are grounds for disqualification.”

The amendment was ratified in 1868 after the Civil War, during Reconstruction, and also addressed the citizenship status of freed slaves and the re-integration of the defeated Confederate states back into the Union.

Applying the 14th Amendment's disqualification rule to Trump has been a rising talking point this month.

The lawyer and a growing chorus of legal scholars, even prominent conservative ones, say that the amendment does not even require a conviction in the courts — but simply a finding that he violated the clause.

I also believe that Trump should be disqualified from the 2024 presidential race due to the “disqualification clause” in the Constitution's 14th Amendment than bans “insurrectionists” from office. What do you think?

I would prefer that Congress stays out of this as under the republican control they are the do nothing congress

18 U.S.C. § 2101 - U.S. Code - Unannotated Title 18. Crimes and Criminal Procedure § 2101. Riots

Just go with federal charges along with the others charges and that should be enough to send him to jail. That should shut everyone up.

They should be able to proof that he incited a riot under the above statue.

Still The classified document case should be another easy win. Add Obstruction of justice, and destroying evidence and witness tampering and he should be getting jail time. There are over 37 counts in federal courts in Florida.

Trump needs to bad mouth DeSantis more just to piss off those judges in Florida.

But it gets WORSE for Trump…

PLEEEASE-- -- -- the whole basis of the suit is based on an opinion concluding the guilt of Trump on actions as yet not even determined or proven.

Must be big money and career-boosting opportunities these days in filing frivolous lawsuits so long as they have the name Trump attached to them.

Since Trump has never been found guilty of insurrection, this is a stretch.
The insurrection clause never required a trial. Or a conviction. It was to be determined by the person responsible for determining a persons qualifications for a position. Example, union soldiers who joined the confederacy, could not rejoin the union army, or hold any federal or state office. But the disqualification had to be made before they could rejoin the army, or hold a federal office. To require a trial, or a conviction would delay their disqualification for months to years.

And such delays could not have been the intention when they passed the 14th amendment.

Utter rubbish. Article 3 of the 14th does not apply, for various reasons. Among these reasons, no mention is made of 'President', while Senator and Representative are specifically mentioned.
As are all civil and military officers of the government.
Remember, the president is commander-in-chief of the military.

Of course, such disability can be overridden by congress

. But Congress may by a vote of two-thirds of each House, remove such disability.

No.

So all enemy democrats have to do is find a communist judge. That should be easy enough.

They didn't attempt a coup.

“Peacefully and patriotically make your voices heard” is the definition of Hate Speech In the 1,000 year democrat Reich

They didn't attempt a coup.

You're saying the Gore-Bush Democrat election deniers in 2000 didn't attempt a coup. Neither did Trump. He's going to be found not guilty by at least one juror in each trial. Hung juries all around which is why we have trial by jury in this country.

Not aware of Gore's followers attacking the capitol, or presenting fake electoral college electors. Care to ennumerate the things you think Gore's followers did to attempt a coup?

LOL. Like that is going to happen in Florida. However, if blue states want to take Trump off the ballot then red states should be allowed to remove Biden from the ballot.
