Their choice made at the time, when everybody else chose not to stay. Represented by good Republican lawyers of their choice. I got no problem with the outcome, since they got to choose, all the way down the line.
I guess they should not have intentionally breached a law passed by Congress, and this Republican congress did not see fit to strike down their law, this session either.
