UPDATE: Judge Napolitano responded to President Trump's tweet in an interview Monday morning on FOX Business network.

In an interview cited by the president on Twitter, legal scholar Alan Dershowitz makes the case for why FOX News judicial analyst Andrew Napolitano is wrong when he says the Mueller report demonstrates that President Trump committed obstruction of justice.

"In my introduction to the Mueller report, I go through the elements of obstruction of justice. The act itself has to be illegal. It can't be an act that is authorized under Article Two of the Constitution," Dershowitz said,

"It can't be obstruction of justice if the president is acting within his authority. Nixon obstructed justice because he acted outside his authority -- destroying evidence, paying hush money, ordering his subordinates to lie to the FBI."

ANDREW NAPOLITANO: When the president asked Corey Lewandowski, his former campaign manager, to get Mueller fired, that is obstruction of justice. When the president asked his then-White House counsel to get Mueller fired and then lie about it, that's obstruction of justice. When the president asked Don McGahn to go back to the special counsel and change his testimony that's obstruction of justice... But ordering obstruction to save himself from the consequences of his own behavior is unlawful, defenseless and condemnable.

FOX NEWS HOST: Do you agree? Is this obstruction of justice?

ALAN DERSHOWITZ: I do not agree. I think Judge Napolitano is terrific and we often agree about the law, but in my introduction to the Mueller report, I go through the elements of obstruction of justice. The act itself has to be illegal. It can't be an act that is authorized under Article Two of the Constitution.

Napolitano's premise is way off. The whole Mueller investigation is unsupportable by the Constitution. If you shut down unconstitutional federal activity, that is NOT obstruction of justice.

shame on you Napolitano

how can FOX even be hiring you?.....you are scum

I can't remember when Napolitano was right about anything...why does he keep his job?...give it to Dershowitz....
Hating Trump turns smart people into morons...and Napolitano is exhibit A....

I don't understand it either, Rambunctious, but when some people get to Napolitano's age, they start forgetting things they used to know, such as a detail of the law, but they know they have stellar credentials, so it never crosses their mind that they could be mistaken about an issue. I don't see Napolitano as an enemy, but I do see gray hair. Derschowitz, on the other hand, gave the better argument, and it sounds to me like he did his homework.

Furthermore, Trump has had several advisers tell him he was wrong, and he did not fire them. And if they can show him the law, and he goes with their counsel, he has not committed any obstruction whatever.

Judge Napalitano, on this issue you're fulla beans. /mallet thump :D

No, no, no, you can't have ANYONE telling you the Emperor has no clothes. Derschowitz was never a judge, and as for senile old farts, Derschowitz is 80 years old and was a defence attorney, not a judge. Derschowitz worked for the guilty, getting them off. That's why he's advising Trump.

You do not need an underlying crime in order to obstruct the investigation.

Yea, sorry but Dershowitz probably knows a tad more than you do.

Derschowitz is a liberal who voted for Hillary. Suddenly you label him as a Trump supporter, which he is not. He happens to be one of the very few liberals with integrity (something you severely lack).

He used to be a Democrat. Calumny specialists like you convinced him to go to the Constitution and do things right. And that's exactly what Alan Dershowitz does.

Oh and if Derschowitz was saying the same as Napolitano you'd be saying how right he is even though he's 80 years old.

Disgusting is what you are.

No Skye; not scum. Just wrong. The Office of Legal Counsel agrees with Dershowitz, Barr and Rosy; Nappy is a good bloke but off on this one.

Drags; before the escalator ride I considered Trump a doofus. After that I looked closely at his policies. His policies Trumped his Doofusdom bigly. I can't even criticise his foibles now as that is what they are; he's good for the Yank family. I like that.

Fox News has a whole host of Trump haters.....doy.....most of the news anchors up to 8pm in the evening. The judge too!

Dershowitz takes his shots at the president when he gets chance....but on Mueller, it's been bumpy cucumber after bumpy cucumber for the DUMS.:113::113:

Unicorn chasing is ghey s0ns!

For some reason Napolitano has an anti Trump agenda. People say that Fox loves Trump, but I have heard several of their hosts and other on air personalities greatly criticize Trump. Sometimes it is justified, but not always. I would believe Dershowitz, a Liberal, more than Napolitano.
