Republicans are sufficiently outraged by the leaked recording of one of Senate Minority Leader Mitch McConnell’s private re-election strategy sessions that they’ve characterized it as a crime. But according to privacy law experts, and legal experts in Kentucky, the question of whether the person who recorded the meeting committed a crime turns entirely on whether he or she was an invited participant.

Wrong....it is a crime to tape somebody without their permission. Why do you think that whenever you call a Public Utility, Bank, etc., they must notify you that the call may be recorded, before transfering you to a live person to speak with.

If one the participants, as suggested, did the taping, then the "one consent" rule is followed.

According to this statue Mother Jones has committed a crime, as well as the person that made the recording.

What "crime" did Mother Jones commit?


And if someone in that meeting recorded it, they didn't commit a "crime" either.

According to the illegal eavesdropping statute:

A person can violate such statutes by the following:

he/she can unlawfully intercept or procure another to unlawfully intercept a wire, oral or electronic communication;
he/she can unlawfully disclose the contents of an electronic, oral or wire communication;​

If someone at the meeting knew about the recording they will be in serious trouble from the McConnell campaign. However, if nobody at the meeting knew this was going on it was a crime according to wiretapping laws. So far nobody has admitted to knowing about it.
