Sure, if he had been going to break in, and she didn't have a gun, it would have been safer to run and hide, not approach him, but what if she had just shot and asked questions later? She'd have killed someone who was just high and disoriented. How often do 14 year olds, by themselves, enter peoples homes, when people are in them, burlarize them, and injure or kill the people? Pretty much never. People who have guns need to think before they use them instead of just shooting. All this guy had to do was fire a warning bullet into the sky, make sure his house was locked up and call the police. He did not need to shoot anyone; you pro-gun people are all just salivating to blow someone away. It's sickening.

Where I live, a high percentage of people have guns. And most of us know, I've grown up knowing, that you let them come inside the house before you shoot them. Odds are, though, if you call the police they'll get there before he's managed to break in the house. If he's stupid enough to break in with a dog barking. You just find yourself a safe place to wait and the instant he comes in that door or window you shoot the motherfucker dead. No need to even talk about retreat in your own house.
We had a case here about a year ago where two teens, like 19-year-olds, knocked on a guy's door and when he opened it they forced their way into his house (they had guns!) because they'd heard he had a lot of cash on hand from selling marijuana. They ordered him to open his safe (idiots) from which he was able to grab his pistol and shoot them both. One died at the scene, the other died later. A third guy was waiting outside for them and he was arrested and charged. The guy who did the shooting even had a modest marijuana grow going (for his own use) and no charges WHATSOEVER were pressed against him.
In this state, anyway, just let the scumbag get inside before you shoot him, and you're perceived as a hero.
Although...I remember another case where a man had another man down and was stabbing him. This was right downtown, on the sidewalk alongside the city streets! Nobody was doing anything, but one passerby ran to his truck and got a gun, came back to the scene and shot the aggressor dead. He was hailed as a hero. No charges were pressed against him and he was not inside his house. But he was trying to save someone's life.

Yes Louisiana has 'Stand Your Ground' laws. Here it would not be considered a break in unless he was in the house. Stand your ground is based upon 'reasonable fear.' If one were to be in the house and the intruder in the lawn, even though he climbed the fence, it would be hard to prove reasonable fear. If the intruder comes in the house, the castle doctrine presumes he is there to do you harm and you can use deadly force.
It seems that Louisiana does have some type of SYG law, but not knowing the facts, I can't really extrapolate how it would apply in this case. I'm guessing Mr. Homeowner is in a heap o' trouble.

Also, the boy does appear to have broken into the property, by scaling the fence, however, he wasn't inside the residence when he was shot. All the man needed to do was to keep an eye on the rear door and phone the police. He could have shot the boy if, and only if, he entered the property.
He is being charged because his life was not threatened. Someone comes onto your property, your life is not in danger until the assailant comes face to face with you.
Yes the pictures can change everything in a new perspective. If you've ever been to New Orleans neighborhoods, the homes are real close together and the driveways are small and gated. Many driveways are enclosed to make courtyards. Funny how a picture can change a lot of things. I was picturing a large front yard and the kid jumping the fence and being quite a way away. This picture puts the whole story in a different light.

That would have been better than shooting him like he was a target at a shooting gallery. Maybe, just maybe, he wasn't breaking in, maybe he jumped the fence because they were playing basketball on the street under the street lights and the ball went over the fence.
I realize that is a stretch at 2am in the morning, but you never know.
Only knowing what the article says, I would say this is a much different case than the Zimmerman case.
