No he's not. Because there is no crime either way. The case is that the payments were made to cover up ANOTHER crime, as yet unspecified. It's unspecified because the prosecution wants to charge some kind of election interference. But, that's a federal crime and cannot be tried in state court. Federal prosecutors have turned it down because they didn't see any crime. So, Bragg has claimed an unspecified crime was committed and expects the jurors to imagine one.
